RESOLUTION NO. 2006- 13 A RESOLUT ION O F THE C ITY O F MOSCOW, A MUN I C I P AL CO R PO RATION O F THE STATE O F I DAHO, TO ALLOW FOR THE TEM PO R A RY VE N D I NG O F BEER A N D/OR W I NE I N E AST C ITY P A RK U N DE R S PE C I F IC REGULAT IONS A N D U N DE R CE RT A I N L I M ITE D CON D IT IO NS PURSUANT TO MOSCOW C ITY CODE 5-13-4(B); P ROV I D I NG THIS RESOLUT IO N TO BE E F FECT IVE U PO N ITS P ASS AGE A N D A P P ROVAL. WHERE AS, Moscow City Code 5-13-4(B) prohibits the possession of alcoholic beverages while present in a City park except in accordance with specific regulations adopted by Council by Resolution; and WHE REAS, East City Park in Moscow is a City Park as defined at Moscow City Code 5-13-3(D); and WHERE AS, Rendezvous in the Park is an activity promoted by Rendezvous in Moscow, Inc., and designed to promote the arts for patrons and the community of Moscow; and WHE REAS, Council wishes to allow for the vending and responsible consumption of beer and/or wine under certain conditions. contained herein and during limited hours during Rendezvous in the Park; and WHERE AS, Council wishes to prohibit the sale and/or consumption of liquor during Rendezvous in the Park; and WHE REAS, Council believes that the specific regulations contained herein balance health and safety concerns of citizens with the desire to promote responsible use of alcoholic beverages; and WHERE AS, based upon the long history of Rendezvous in the Park in East City Park, Council believes the regulations contained herein are appropriate; and WHERE AS, nothing contained in this Resolution is intended to waive other laws and regulations applicable to the sale and consumption of alcohol within City limits; and WHE REAS, nothing contained within this Resolution is intended to endorse or support any particular belief, philosophy, or political position of Rendezvous in the Park, and/or its affiliates, associations, contributors, supporters, participants, etc.; and WHERE AS, nothing in this Resolution shall establish any precedent for this event, a similar event, or this event in the future; and WHERE AS, these conditions are specific to this event and to none other; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Moscow, Idaho as follows : SPECIFIC REGULATIONS ON THE SALE AND/OR CONSUMPTION OF BEER AND/OR WINE DURING RENDEZVOUS IN THE PARK, 2006: Intent: This Resolution is intended to allow the sale and consumption of beer and wine only (and not liquor), pursuant to these specific regulations and is not intended to amend or expand the Moscow City Code or Rr·:sorrno;-.; 2006 ··13 BLER-W!NF SALES RE:-.
