AGREEMENT FOR WATER SERVICES OUTSIDE CITY LIMITS This Agreement entered into on the 3rd day of August 1992 between Steven and Karen Tabor, owners of real property located within Latah County Idaho, generally described as 1508 Orchard Avenue, Moscow, Idaho ("Owner") and the City of Moscow, a municipal corporation of the State ofldaho ("City") as follows: WITNESSETH: Whereas the City of Moscow owns and operates a water system within the City of Moscow, providing water service to the residents of the City; Whereas the City may provide water services to non-city residents upon the satisfactory completion of certain conditions, including payment of fees; NOW THEREFORE, in consideration of the foregoing premises and in further consideration of the mutual promises and agreements hereinafter contained, it is agreed as follows: 1. That the City will provide water services to 1508 Orchard Avenue upon the following conditions: a. That the owner of 1508 Orchard Avenue shall pay five hundred ten dollars ($510.00) to the City for water meter; b. That the owner of 1508 Orchard Avenue shall pay five hundred forty five dollars ($545.00) to the City for systems fee; c. That the owner of 1508 Orchard Avenue shall pay one thousand four hundred dollars ($1400.00) to the City for special charge for the Orchard A venue water line; d. That the owner of 1508 Orchard Avenue pay two hundred percent (200%) of the minimum service charge and water rate charge for City water service; AGREEMENT FOR WATER SERVICES OUTSIDE CITY LIMITS PAGE 1 ---PAGE BREAK--- e. That the owner of 1508 Orchard Avenue shall not oppose annexation of said property into the City in the event that the City seeks annexation. 2. If the owner of 1508 Orchard Avenue fails to comply with any of the terms of this Agreement or conditions contained herein, that water service to that location shall be terminated without further notice, and the owner of 1508 Orchard Avenue shall hold the City harmless for all damages or causes of action arising from such termination of service. 3. That this Agreement shall be binding upon the heirs, successors, assignees and purchasers of the parties hereto. It is presently located in Latah County and receives water from a well. We have negotiated with the sellers, Mr & Mrs Tabor, to have them connect the house to City of Moscow water service. We understand and accept that connection to city water will cost double fees for water service until the property is annexed to the city.
