RESOLUTION NO. 2007 - 02 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AMENDING THE EXISTING CITY POLICY AND ESTABLISHING A MAXIMUM OF EIGHTY (80) HOURS OF ACCUMULATED COMPENSATORY TIME; PROVIDING THIS RESOLUTION TO BE EFFECTIVE UPON ITS PASSAGE AND APPROVAL. WHEREAS, the business needs of the City of Moscow may make it necessary to require overtime; and WHEREAS, the Fair Labor Standards Act defines "overtime" as pay of one and one-half (1 112) times the regular rate of pay for all hours worked in excess of forty (40) hours in a work week for non-exempt employees; and WHEREAS, City will allow the accumulation of compensatory time in lieu of a cash payment in exchange for the overtime earned; and WHEREAS, City has received a request to increase the maximum per employee accumulation of compensatory time from fifty (50) hours to eighty (80) hours; and WHEREAS, City believes increasing the compensatory time allowed will provide more flexibility to City staff and departments in regard to scheduling, efficiency, time management and time utilization; and WHEREAS, changes provided in this Resolution shall be incorporated in "City of Moscow, Idaho Personnel Policies"; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Moscow as follows: 1. City non-exempt (hourly) employees (as defined by the Fair Labor Standards Act) shall receive overtime pay of one and one-half (1 Y2) times their regular rate of pay for all hours worked in excess of forty (40) hours in a work week. 2. The City shall allow the accumulation of compensatory time in lieu of cash in an amount not to exceed eighty (80) hours at any time. Compensatory time shall not be accumulated for work performed during University Special Events; overtime earned from such University Special Events shall be compensated for by one and one-half ( 1 112) times regular pay. 3. No other changes will be made to the Overtime I On Call Time provisions of the City of Moscow, Idaho Personnel Policies. 4.
