LEASE AGREEMENT This lease, entered into by and between the City of Moscow, a Municipal Corporation of Idaho, hereinafter referred to as the 'CI1Y' and Eugene Thompson and JoAnn Thompson, husband and wife, hereinafter referred to as 'LESSORS'; WITNESSETH: I. PREMISES LEASED. Upon the terms and conditions hereof, the LESSORS have granted. and the CI1Y has accepted the right to lease and utilize the following described property: Block 1, Lot 8, Arrowhead Addition No. 1 to the City of Moscow, Latah County, Idaho. II. PURPOSE OF LEASE. The above described premises will be used on a short-term basis for the collection, storage, and transportation of household and small business generated hazardous waste. III. CONSIDERATION. As considered for this lease the CI1Y has paid the LESSORS the sum of ten dollars ($10.00), receipt of which is hereby acknowledged. IV. TERM. This lease shall be for a term of seven days beginning April28, 1994 and continuing through May 6, 1994. V. CI1Y ASSUMES RISK. The CI1Y shall assume all risks incident to or in connection with the activity conducted hereunder and shall hold LESSORS harmless for any accidents or injuries of whatsoever nature or kind to persons or properties caused by the CI1Y'S activities at these premise. LESSORS assume no responsibility whatsoever for any property placed on said premises and LESSORS are hereby expressly released and discharged from ---PAGE BREAK--- any liability for any loss injury or damage to persons or properties that may be sustained by reason of the occupancy under this lease. VI. CLEANUP OF PROPER1Y. Prior to expiration of this lease, the CI1Y shall ensure that all waste and debris is removed from the property and that the property is returned to LESSORS in a condition which is as clean or cleaner than the date the property was occupied by the CI1Y. VII. ASSIGNABILI1Y. The CI1Y shall not assign this lease nor sublet these premises.
