PERMANENT WATERLINE EASEMENT 5 5 6 2 0 ' SUSAN PETERS ɡ J=EE $ BY LATAI l;UNTY RF.l ER LENNARD CHIN FAMILY, L.L.C., an Idaho limited liability company, GRANTOR, owner of real property affected hereby, for value received, does hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, GRANTEE, and its agents and assigns, a non-exclusive permanent easement and right-of-way in which to construct and maintain a public waterline and related appurtenances, including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, as shown on the attached Exhibit and being more particularly described as follows: A strip of land located in the NW1/4 of Section 17, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, being twenty feet (20') in width, ten feet (1 each side of the following described centerline: Commencing at the southwest corner of the NW1/4 of said Section 17, Township 39 North, Range 5 West, BM; thence along the westerly line of said NW1/4, N0°54'38"E 485.50 feet; thence departing said westerly line, 889°37'1 B"E 40.00 feet, to the southwest corner of that certain parcel described in Quitclaim Deed, Instrument No. 450058 and shown on Record of Survey for Clyde and Bond Enterprises, L.L.C., Instrument No. 553744; thence along the southerly line of said certain parcel, S89°37'18"E, 80.56 feet, to the POINT OF BEGINNING of said easement centerline; Thence departing said southerly line, S0°11'06"W, 121.06 feet, more or less, to the intersection with the northerly right-of-way line of Henley Street, being the POINT OF ENDING of said easement centerline. The side lines of said twenty feet (20') wide easement to be extended or shortened to terminate at the northerly and southerly lines of that parcel described in Quitclaim Deed, Instrument No. 544572. for the purpose of constructing, operating, maintaining, and repairing or replacing a public waterline and related appurtenances by the City of Moscow or its agents or contractors. GRANTOR, its successors and assigns, reserves the right to improve said easement area as long as such improvement shall not unreasonably interfere with the construction, operation, maintenance, repair and/or reconstruction of said waterline. GRANTOR agrees that it and its successors or assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of GRANTEE. GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid waterline (including, but not limited thereto, the right to make necessary repairs, alterations, and removals or replacement thereof). Upon exercising these rights, GRANTEE shall restore the property to its prior condition. GRANTEE is granted the aforementioned rights, together with the rights and privileges of ingress and egress to and from said property for the above stated purposes.
