RESOLUTION NO. 2017 - 01 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE ST ATE OF IDAHO, PROVIDING FOR THE ADOPTION OF A REVISED STREET TREE PLANTING PROGRAM; PROVIDING THAT THIS RESOLUTION BE IN EFFECT UPON ITS PAS SAGE AND APPROVAL. WHEREAS, the City adopted a Tree Planting Program pursuant to Resolution No. 1997-04, and established a Tree Planting Dedication Fund, pursuant to Resolution No. 1999-01, and amended in Resolution No. 2000-02, which Fund is used to facilitate the planting of street trees pursuant to Moscow City Code Title 5, Chapters 1 and 8, and City of Moscow Standard Construction Specification and Drawings, as adopted; and WHEREAS, Tree Planting Dedication Fund utilization rates have historically been around sixty percent leaving some subdivisions without adequate Street Trees; and WHEREAS, the benefits of Street Trees include producing oxygen and cleaning pollutants from the air, filtering stormwater runoff, stabilizing soils to help with erosion and flood control, providing shade which reduces cooling costs in the summer, and reducing noise levels and glare; and WHEREAS, street trees create safer walking environments by forming and framing visual walls and providing distinct edges to sidewalks so that motorists better distinguish between their environment and one shared with people; and WHEREAS, street trees create a sense of place and add significantly to the aesthetics of the urban environment; and WHEREAS, on December 10, 2015, the Street Tree Advisory Committee recommended the revisions to the current Street Tree Planting Program contained herein; and WHEREAS, the City of Moscow Strategic Plan identifies a long-term goal to increase the vitality of Moscow's tree canopy; and WHEREAS, the Council desires that subdivision developers, contractors, homeowners, and other persons interested in the planting of trees within the City be made aware of the program and its related guidelines; and WHEREAS, Council desires to amend the Moscow Tree Planting Program as provided in this Resolution; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Moscow as follows: RESOLUTION 2017 -01 TREE PLANTING DEDICA T!ON FUND, AMENDED PAGE 1 OF3 ---PAGE BREAK--- A. MOSCOW STREET TREE PLANTING PROGRAM (The Process from Planning through Planting) 1. Street trees shall be required to be installed prior to the issuance of a building permit. The contractor submits plans to the Community Development Department for a new principal structure, or the substantial improvement to any existing principal structure upon any lot or parcel or land within the City of Moscow. 2. The number and size of street trees required for each property shall be determined in accordance with Resolution No. 2017-01 and the City's Arboricultural Standards and Specifications Guide. 3. Prior to the installation of any required street tree, a permit to plant shall be obtained from the Community Forestry Administrator in order to review the appropriateness of species and location. 4. Prior to the issuance of a building permit for any new single-family or two-family dwelling, or the substantial improvement to any existing single-family or two-family dwelling, the applicant shall install the required street trees; or enter into an agreement which shall require the installation of the required street trees prior to the issuance of the final Certificate of Occupancy for the structure; or furnish a financial security in a form acceptable to the City in the amount set by the current Fee Resolution, as adopted by the Council. 5. Prior to the issuance of a building permit for any multi-family or commercial principal structure, or the substantial improvement to any existing multi-family or commercial principal structure, the applicant shall submit a landscape plan that shall identify the number, location and type of street trees proposed for approval by the Community Forestry Administrator. The required street trees for such projects shall be installed prior to the issuance of the Certificate of Occupancy for any multi-family and commercial principal structure. If a Certificate of Occupancy is requested to be issued prior to the installation of the required street trees, the applicant shall furnish a financial security in a form acceptable to the City in the amount set by the current Fee Resolution, as adopted by the Council. 6. The amount of the financial security shall be established within the City of Moscow Fee Resolution as adopted by the Council and shall be in a form of cash, bond, or other security deemed acceptable to the City. 7. Financial security for any required street tree(s) shall be released to the applicant or property owner within sixty (60) days of the inspection and approval of the street tree installation by the Community Forestry Administrator. 8. The trees can be planted by the homeowner or a contractor paid by the homeowner. 9. If an applicant does not install the required street tree(s) within twenty-four (24) months from the date of the Certificate of Occupancy for the principal structure, the City may utilize the security to pay the costs of installing the required street trees. After one year, a follow-up inspection of the plantings is done to determine their condition. B. STREET TREE PLANTING PROGRAM GUIDELINES 1. The following shall be the required tree planting allotment for each type oflot. Deviation from the standards as described in B.1. shall be approved in writing by the Community Forest Administrator. a. Comer Lots -Four trees per lot. b. Regular Lots -Two trees per lot. c. Cul-de-sac Lots - One tree per lot. d. Flag Lots -No trees. e. Developed Lots - Tree allotment will be determined on a case-by-case basis. f. Commercial I Other Lots - Tree allotment will be determined based on the City's Arboricultural Specifications and Standards Guide. 2. For purposes of computation and assessment of required tree plantings, trees are assumed to be large growing trees fifty feet (50') or more at maturity). The recommended size of the tree at planting is one and three-fourths inches (1 caliper as measured at six inches above ground level. 3. All calculations, species selections, and plantings should comply with the City's Arboricultural Standards and Specifications Guide. This Resolution specifically repeals Resolution No. 2000-02 and any resolution that conflicts with the current resolution, and this Resolution shall be in full force and in effect as of the date of its passage.
