RESOLUTION NO. 2002-01 A RESOLUTION OF THE CITY OF MOSCOW, OF LATAH COUNTY, IDAHO, DIRECTING PUBLICATION OF A NOTICE OF PRIVATE SALE OF THE CITY'S GENERAL OBLIGATION BONDS IN ACCORDANCE WITH LAW; AND PROVIDING FOR OTHER MATTERS PROPERLY RELATING THERETO CITY OF MOSCOW Latah County, Idaho BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOSCOW, of Latah County, Idaho, as follows: WHEREAS, the City of Moscow, of Latah County Idaho, (the "City"), is a municipal corporation operating and existing under and pursuant to the provisions of the Constitution and laws of the State ofldaho; WHEREAS, on September 17, 2001, adopted Ordinance No. 2001-19, setting a special election to seek the authorization of the issuance of general obligation bonds in the aggregate principal amount of up to $2,500,000 to construct and equip a new fire station, and providing for other matters related thereto; WHEREAS, at the special election held on November 6, 2001, the voters of the City approved the issuance and sale of the general obligation bonds for such purpose; and WHEREAS, Idaho Code Section 57-215 has recently been amended to authorize general obligation bonds to be sold at private sale after notification by publication, and the City Council has determined it is in the best interests of the City and the residents thereof to sell such bonds at private sale; NOW, THEREFORE, IT IS HEREBY FURTHER RESOLVED as follows: Section I: That the Notice of Intent to Sell Bonds at Private Sale, in substantially the form attached hereto as Exhibit and incorporated herein by reference, shall be published once in a newspaper of general circulation within the City at least three days prior to the date of such sale, in compliance with law. Section 2: The appropriate officers or employees of the City are hereby authorized to take any other action necessary to implement I. C. 57-215 or the private sale of the bonds. Section 3: This Resolution shall take effect and be in force from and after its passage and approval. - l - ---PAGE BREAK--- ADOPTED this 7th day of January, 2002. ( S E A L ) ---PAGE BREAK--- I, the undersigned, City Clerk of the City of Moscow, of Latah County, Idaho hereby certifY that the foregoing Resolution is a full, true, and correct copy of a Resolution duly adopted at a regular meeting of the City Council, duly and regularly held at the regular meeting place thereof on January 7, 2002, of which meeting all members of said Council had due notice and at which a majority thereof were present; and that at said meeting said Resolution was adopted by the following vote: AYES, and in favor thereof, Councilmembers: Mike Thomason, Steve Busch, JoAnn Mack, Linda Pa 11 NAYS, Councilmembers: none ABSENT, Councilmembers: Jack Hi 11, Peg Hamlett ABSTAIN, Councilmembers: none I further certifY that I have carefully compared the same with the original Resolution on file and of record in my office; that said Resolution is a full, true, and correct copy of the original Resolution adopted at said meeting; and that said Resolution has not been amended, modified, or rescinded since the date of its adoption, and is now in full force and effect.
