ORDINANCE NO. 1073 AN ORDINANCE VACATING THAT CERTAIN STReeT IN HIGHLAND VIEW ADDITION TO THE CITY OF MOSCOW, LATAH COUNTY, STATE OF IDAHO, ADJACENT TO LOTS ONE TWO THREE FOUR AND FIVE IN BLOCK FOUR OF SAID ADDITION, AND PROVIDING THAT SAID STREET SO VACATED SHALL REVERT TO THE OWNERS OF THE ADJACENT REAL ESTATE AS PROVIDED BY THE STATUTES AND COURT DECISIONS RELATING THERETO OF THE STATE OF IDAHO; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO: SECTION 1. That that certain street in Highland View Addition to the City of Moscow, Latah County, State of Idaho, adjacent to Lots One Two Three Four , and Five in Block Four of said addition, and more particularly described as follows, to wit: Beginning at the northwest corner of Lot One in Block Four of Highland View Addition to the City of Moscow, as shown by the recorded plat thereof, and running thence South two hundred sixty (260) feet along the west line of Lots One Two Three Four and Five in said Block Four to the corner of said Lot Five thence West thirty (30) feet; thence North two hundred sixty (260) feet along the west boundary line of Residence Street to the south boundary line of "C11 Street; thence East thirty (30) feet to the point of beginning; be, and the same is, hereby vacated; subject, however, to the City maintaining an easement therein for the purpose of maintaining a water line which transverses said property from the North to the South; that the legal description for said easement is the following-described property situated in Latah County, Idaho, to wit: Beginning at a point ten (10) feet West of the northwest corner of Lot One in Block Four of Highland View Addition to the City of Moscow, Idaho, as shown by the recorded plat thereof; and running thence South a distance of two hundred sixty (260) feet on a line ten (10) feet West and parallel to the West lines of Lots One Two Three Four and Five in said Block Four thence West a distance of ten (10) feet; thence North a distance of two hundred sixty (260) feet; thence East a distance of ten (10) feet to the point of beginning. SECTION 2. That the street so vacated shall revert to the owners of the adjacent real estate as provided by the statutes and court decisions relating thereto of the State of Idaho. SECTION 3. This ordinance shall be in full force and effect from and after the date of its passage, approval and publication. PASSED by the Council and APPROVED by the Ma or December, 1963.
