O RDINANCE NO. 1128 AN ORDINANCE VACATING THE STREET OR ALLEY ACROSS THE FOLLOWING DESCRIBED PROPERTY IN LATAH COUNTY, IDAHO, TO-WIT: The North One Hundred Sixteen and Twenty-five Hundredths (116.25) feet of the Alley in Block Two of Lieuallen's Fourth Addition to the City of Moscow as shown on the recorded plat thereof. AND PROVIDING THAT SAID PROPERTY SO VACATED BUT SUBJECT TO AN EASEMENT THEREON TO THE CITY OF MOSCOW SHALL REVERT TO THE OWNERS OF THE ADJACENT REAL PROPERTY IN THE MANNER PROVIDED BY SECTION 50-1124 OF THE IDAHO CODE, OR AN Y THEREOF;AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW,IDAHO: SECTION 1. That the street or alley across the following described property, located in Latah County, Idaho, to-wit: The North One Hundred Sixteen and Twenty-five Hundredths (116.25) feet of the Alley in Block Two of Lieuallen's Fourth Addition to the City of Moscow as shown on the recorded plat thereof, be and the same is hereby vacated subject however, to a permanent easement thereon to the City of Moscow, Idaho, for the purpose of maintaining or servicing any and all utilities that are now located on or may be located thereon or for public use thereon as an alley if the City may deem it necessary. SECTION 2. That the street or alley so vacated but subject to such reservations shall revert to the owners of the adjacent real property as provided by Section 50-1124 of the Idaho Code or any amendment thereto. SECTION 3. Th is ordinance shall be in full force and effect from and after the date of its passage, approval and publication.
