(-IJ) 3·;0* SUSAN PETERSEN ORDINANCE NO. 2009-11 LATAHCOUNTYREC Fee$ BY AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION 0 STATE OF IDAHO, PROVIDING THAT LAND DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND GENERALLY SHOWN ON EXHIBIT ATTACHED HERETO AND INCORPORATED BY THIS REFERENCE BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, land described in Section 1 of this Ordinance are adjacent to City limits on one side; and WHEREAS, the land described in Section 1 of this Ordinance have been requested to be annexed by the owner or representative thereof; and WHEREAS, Idaho Code Section 50-222 authorizes City annexation of tracts of land adjacent to the City; and WHEREAS, the Moscow Planning and Zoning Commission held a public hearing regarding this matter on April 22nd, 2009; and WHEREAS, the Moscow Mayor and City Council held a public hearing regarding this matter on June 1st, 2009; and WHEREAS, the annexation described herein has been deemed consistent with Moscow annexation policy set forth in Resolution 2007-1. NOW THEREFORE, be it ordained by the Mayor and Council of the City of Moscow as follows: SECTION 1: LEGAL DESCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: A parcel of land located in the NW1/4SE1/4 and the SW1/4SE1/4 of Section 9, T39N R5W, BM and being more particularly described as follows: Beginning at the northeast comer of the SW1/4SE1/4 of Section 9 and the TRUE POINT OF BEGINNING: Thence S 0°29'30" W, 60.00 feet, along the east line of said SW1/4SE1/4 of Section 9, to the northeast comer of Rolling Hills ih Addition to the City of Moscow; Thence N 89°30'24" W, 242.37 feet, along the north line of said Rolling Hills ih Addition; Thence leaving said north line, N 69°12'15" E, 132.71 feet; Thence N 77°18'21" E, 57.22 feet; Thence N 81 °16'20" E, 63.83 feet, to a point on the east line of the NW1/4SE1/4 of Section 9; 0ROINANCE2009- II McGURKIN ANNEXATION ORDINANCE PAGE I of3 ---PAGE BREAK--- 530055 Thence S 0°29'30" W, 11.47 feet, along said line to the TRUE POINT OF BEGINNING. Parcel contains 0.23 acres, more or less (1 0,207 square feet±) SECTION 2: ANNEXATION: The land described in Section 1 of this Ordinance be and the same hereby are, annexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the ·necessary amendments to the official City limits map, zoning map, and Area of City Impact map for the City of Moscow, Idaho, which are on file at City Hall. SECTION 3: SEVERABILITY: Provisions of this Ordinance including every exhibit subpart of Section 1 of this Ordinance, shall be deemed severable and the invalidity of any provision of this Ordinance including any exhibit subpart of Section 1 of this Ordinance, shall not affect the validity of remaining provisions or subparts. SECTION 4: EFFECTIVE DATE: This Ordinance shall be effective upon its passage, approval and publication according to law.
