Box 837 Lewiston, ID 83501 WAIVER OF HEARING For The Idaho Transportation Department Project No. A012 (001); SH-8 White Place to South Fork Palouse River Bridge Latah County, Idaho Key No. 12001 The undersigned entity agrees that there are no utility relocation, adjustment, or removal of its facilities within the construction limits of this project, as shown on the plans and work schedule included herein and hereby waives further written notice and opportunity for hearing under the provisions of Section 40-312(3) of the Idaho Code/ relative to the relocation, adjustment, or removal of its facilities. Excerpt from Section 40-312(3) of the Idaho Code: "Whenever the board shall determine, after notice and opportunity for hearing, that it is necessary that any facilities which now are, or hereafter may be, located in, on, along, over, across, through or under any federal-aid primary or secondary system or on the interstate system, including extensions within urban areas, should be relocated, the utility owning or operating the facilities shall relocate them in accordance with the order of the board." CITY OF MOSCOW BY: TITLE: DATE : 1'2-,1-010 • .2,010·([ ---PAGE BREAK--- Memo To: Mayor Nancy Chaney From: Kevin Lilly, City Engineer Date: March 11 , 2010 City of Moscow Public Works Department Re: Idaho Transportation Department: State Highway 8, White Place to South Fork of Paradise Creek Stimulus Project- Waiver of Public Hearing Mayor Chaney, The Idaho Transportation Department has an opportunity to apply for an additional stimulus project that would improve the section of State Highway 8 from White Place to Mountain View. To increase their chances of funding, they are attempting to have the project submitted to lTD Headquarters by Friday, March 12, 2010. City of Moscow Public Works has been kept informed on the project, and is planning to adjust our utilities to accommodate them. lTD District 2 is asking for City approval of a waiver of utility hearing. The hearing opportunity is normally provided in order to resolve conflicts relative to relocation and/or adjustment of utilities. In this instance, all City issues have been resolved, and I am requesting that you sign and return the attached Waiver of Public Utility Hearing form to me for forwarding to the District 2 Design Section.
