ACCESS AGREEMENT THIS ACCESS AGREEMENT is between Charles Bond, 708 W. Street, Moscow, Idaho, 83843, owner of property described as 403, 405, and 407 College Avenue in Moscow, Idaho (hereinafter "The Yacht Club"), and the City of Moscow, Idaho, a municipal corporation of the State of ldaho, 206 East Third Street, Moscow, Idaho, 83843 (hereinafter "the City"). The term "City" will include its members, directors, employees, and contractors employed by the City. The purpose of this Agreement is to allow the City to install water level monitoring equipment in and to retrieve water level information from a well situated on the Yacht Club described above. 1. This Access Agreement is intended to be long-term but the owner of the Yacht Club may, at any time, terminate the City's access to and collection of data from the well. Any termination of this Access Agreement shall be preceded by a thirty (30) day notice delivered in person or by first class mail to the City. The City shall also be allowed to remove any equipment that it has installed in the well following receipt of the thirty (30) day notice of termination and before its expiration. The only information that may be taken from the well site shall be water levels, and/or information regarding Tritium, Oxygen 18 or Carbon 14. Any other information gathered shall void this Access Agreement and the City's access to the Yacht Club for purposes of this Access Agreement shall terminate immediately and automatically. 3. The City shall be allowed to retrieve information at any time, provided that the City's activities do not disrupt the intended use of the Yacht Club. 4. The City shall be allowed to pump water from the well, provided that the water is disposed of in accordance with city policies, proper notice is given to owner, and no disruption of intended use of the Yacht Club occurs.
