· ORDINANCE NO. 1069 - AN ORDINANCE AMENDING ORDINANCE NO. 927 OF THE CITY OF MOSCOW ( WHICH ORDINANCE NO. 927 WAS CODIFIED AS TITLE 4, CHAPTER l OF THE MUNICIPAL CODE OF THE CITY OF MOSCOW, 1958 EDITION) , BY ADOPTING AS THE OFFICIAL BUILDING CODE FOR THE CITY OF MOSCOW THAT CERTAIN DOCUMENT AS SET FORTH AS A CODE IN BOOK FORM MARKED AND DESIGNATED AS "UNIFORM BUILDING CODE, 1961 EDITION, PUBLISHED BY INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS", AS AMENDED, DELETED AND ADDED TO HEREIN; PROVIDING FOR THE REPEAL OF ANY INCONSISTENT ORDINANCES; PROVIDING FOR A SEVERANCE AND SAVINGS CLAUSE; AND FOR EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO: SECTION l. Section One of Ordinance No. 927, which is Title 4, Chapter l of the Municipal Code of the City of Moscow, 1958 Edition, is hereby amended to read as follows: "Section One. That a certain document, three copies of which are on file in the Office of the City Clerk of the City of Moscow, being marked and designated as "Uniform Building Code, 1961 Edition, published by International Conference of Building Officials" be, and the same is, hereby adopted as the building code of the City of Moscow, for regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area, and main- tenance of all buildings and/or structures in the City of Moscow, except those amendments thereof and additions and deletions thereto herewith specifi- cally set forth:" and that part of Section One of Ordinance No. 927 which reads as follows: "Section 2404, subsection ( c) of said Uniform Building Code, referring to Non-Bearing Walls and Partitions under the General Heading of Masonry, is hereby amended to read as follows: Non-Bearing Walls and Partitions Subsection 1.-The minimum thickness of Non-Bearing exterior walls, constructed of either plain or re-enforced concrete, shall be six ( ) inches, including walls classed or designated as being panel or curtain types of construction. Subsection 2.-Wire mesh may be used to resist tensile stresses when embedded in plaster applied to the surface of the wall. Plaster shall be as specified in Chapter 47." ---PAGE BREAK--- . - is amended to read as follows: "Section 2419, subsection ( c) of said Uniform Building Code, referring to Non-Bearing Walls and Partitions under the General Heading of Masonry, is hereby amended to read as follows: Non-Bearing Walls and Partitions Subsection .-The minimum thickness of Non-Bearing exterior walls, constructed of either plain or re-enforced concrete, shall be six inches, including walls classed or designated as being panel or curtain types of construction. Table No. 3-A, of Section One, Ordinance No. 927, which reads as follows: "When the valuation does not exceed $100 is amended to read as follows: "When the valuation does not exceed $100 No Fee" SECTION 2. That said Ordinance No. 927, which is Title 4, Chapter 1 of the Municipal Code of the City of Moscow, 1958 Edition, is hereby affirmed and approved except as hereinbefore amended. SECTION 3. All ordinances, or parts of ordinances, in conflict with this ordinance, insofar as said ordinances in any way conflict with this ordinance, are hereby repealed. SECTION 4. If any section, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not effect the validity of the remaining sections, sentences, clauses or phrases of this ordinance, or the ordinance as an entirety, it being the legislative intent that this ordinance shall stand notwithstanding the invalidity of such section, sentence, clause or phrase. SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage, approval and first publication thereof.
