RESOLUTION NO. 98-09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOSCOW, OF LATAH COUNTY, IDAHO, CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE SPECIAL BOND ELECTION HELD ON MAY 2 6, 1998, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY THE QUESTION OF THE ISSUANCE OF GENERAL OBLIGATION BONDS OF THE CITY IN THE AMOUNT OF $3,275,000; AND PROVIDING AN EFFECTIVE DATE WHEREAS, a special bond election was duly held on Tuesday, May 26, 1998, for the purpose of submitting to the qualified electors of the City of Moscow, Latah County, Idaho (the "City") the question of whether or not the City should be authorized to issue its general obligation bonds in the principal amount of $3,275,000, to pay the cost of acquiring a site and acquiring, constructing, a public swimming pool, together with related improvements and costs incidental thereto (the "Project"), as set forth in Ordinance No. 9 8-0 7 of the City, adopted on March 2 3, 1998, as amended by Ordinance No. 98-08, adopted on April 6, 1998; and WHEREAS, the judges and clerks of the conducted the election and made their return provided by law; and election have in the manner xyEREAS, the City Council now desires to canvass the returns and to declare the results of the election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOSCOW, IDAHO, as follows: Section 1: ELECTION The special bond election of May 26, 1998, on the Project, was duly and regularly called, noticed, held, and conducted, the votes cast thereat received and canvassed, and the returns thereof made in the time, form, and manner required by law and by the ordinances, orders, resolutions, and proceedings taken by the City. Section 2: NOTICE OF ELECTION Notice of the election was duly and lawfully given by five publications in a newspaper of general circulation in the City, once a week on the same day of the week for five consecutive weeks, the first of which publications was at least forty-five days prior to said election. Page 1 ---PAGE BREAK--- Section 3: POLLS The polls of the special bond election were opened at 8:00 o'clock A.M. on May 26, 1998, and remained open continuously until closed at the hour of 8:00 o'clock P.M., at the voting place duly provided by Ordinance No. 98-07, adopted March 23, 1997, as amended by Ordinance No. 98-08 adopted on April 6, 1998. Section 4: QUALIFIED ELECTORS Only persons who were, on May 26, 1998, United States citizens who at the time of the specified bond election had been bona fide residents of the City for at least thirty (30) days immediately preceding the election, duly registered to vote therein, were permitted to vote at the special bond election, and no person qualified and registered to vote at said election was refused the right to vote. Section 5: BALLOTS Voting at the special bond election was by ballot, and the ballots used at the election were in the form prescribed by law. Section 6: CANVASS The City Council has examined the returns of the special bond election and hereby canvasses the returns and declares the results of the election on the proposition of whether or not the City should issue its general obligation bonds in the amount of $3,275,000, for the purposes stated in Ordinance No. 98-07, adopted on March 23, 1998, as amended by Ordinance No 98-08, adopted on April 6, 1998. The total number of votes cast at the special bond election for and against the proposition was as follows: Total votes cast, q3r,7s8t9u ; votes for, 2 890 votes against, v8w6u7 _ Section 7: AUTHORIZATION TO PROCEED Upon canvass, it is found that the requisite two-thirds majority of the votes so cast at the special bond election were cast in the affirmative; that the proposition on the issuance of general obligation bonds for the Project in the principal amount of $3,275, 000 duly passed; that the special bond election was held and conducted in compliance with law; and that the City is authorized to proceed with the authorization and issuance of the bonds as specified in said proposition. Page 2 ---PAGE BREAK--- Section 8: RATIFICATION All actions taken by the City in connection with the special bond election, the publication of notice thereof, the preparation and printing of ballots and sample ballots used at the election, and all other matters connected therewith, are hereby in all respects ratified, approved, and confirmed. Section 9: EFFECTIVE DATE This Resolution shall take effect and be in force immediately upon its passage and approval. DATED this 28th day of May, 1998.
