RESOLUTION NO. 2006 - 11 A RESOLUTION ACCEPTING DEED OF DEDICATION OF PROPERTY FOR PUBLIC RIGHT OF WAY AS A WEST SECTION OF NORTH ALMON STREET. WHEREAS, City of Moscow, Idaho has determined that it is in its best interest to accept the dedication of land described herein below as public right of way; and WHEREAS, acceptance of such right of way is in accordance with Idaho Code, Title 50, Chapter 13; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOSCOW, IDAHO that the City shall accept dedication of the property described herein below as public right of way. RESOLVED THIS 3rct day of April, 2006. 1. Legal Description as follows: A portion of that parcel of land described in Quit Claim Deed No.274187 on file with the Recorder's office of said Latah County, situated in the NE1/4, of Section 7, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, with said portion being more particularly described as follows: Beginning at the northeast corner of said Section 7, thence S86°30'W, along the north line of said Section 7, 400.15 feet (deed 394.57 feet), to a point on the former westerly right-of-way line of the Burlington Northern Railroad; thence S10°06'W, 1335.92 feet (deed 1334.41 feet), along said westerly right-of-way line to a point of curvature (railroad station 4578+94.9); thence southerly 341.24 feet, along a curve to the left, said curve having a radius of 2342.01 feet, a central angle of 08°20'54", and a chord bearing S05°55'33"W, 340.94 feet, to the northwest corner of the Robinson tract as described in Instrument No.367643 as recorded at the Latah County Courthouse, Moscow, Idaho, and being the TRUE POINT OF BEGINNING; thence continuing southerly along said former westerly right-of-way line of the Burlington Northern Railroad, 135.67 feet, along a curve to the left, said curve having a radius of 2342.01 feet, a central angle of 03°19'09", and a chord bearing S00°05'35"W, 135.65 feet; thence continuing along said westerly right of-way line, S01 °34'00"E, 227.55 feet, to the southwest corner of said Robinson tract; thence continuing along said westerly right-of-way line, S01 °34'00"E, 646.25 feet to the point of intersection with the south line of said NE1/4 of Section 7; thence along said south line, S86°47'23"W, 33.90 feet; thence departing said southerly line, N04°58'08"W, 107.84 feet; thence northerly 75.03 feet, along a curve to the right, said curve having a radius of 767.70 feet, a central angle of 05°35'59", and a chord bearing N02°10'08"W, 75.00 feet; thence N00°37'51"E, 274.09 feet; thence northerly 254.94 feet, along a curve to the left, said curve having a radius of 2090.61 feet, a central angle of 06°59'13", and a chord bearing N02°51'45"W, 254.78 feet; thence N06°21'22"W, 45.76 feet; thence northerly 256.43 feet, along a curve to the right, said curve having a ---PAGE BREAK--- radius of 1667.52 feet, a central angle of 08°48'40", and a chord bearing N01°57'02"W, 256.18 feet; thence S88°14'54"E, 45.87 feet to the TRUE POINT OF BEGINNING.
