CRDINANCE NO.. 1046 AN ORDINANCE VACATING THAT PGRTION OF PUBLIC ROAD NO. 437, entitled RE EXTENSION OF MOSCOW SIXTH STREET, LYING AND BEING LOCATED WEST OF THE WEST OJRB LINE OF RAYBURN STREET NORTH OF SIXTH STREET AS THE SAME IS NOW ESTABLISHED, V\HICH PUBLIC ROAD IS RECORDED IN BOOK THREE PAGES 608 and 609, ROAD RECOID, LATAH COONTY, IDAHO; AND PROVIDING THAT THE STRIP OF GRaJND SO VACATED SHAll REVERT TO THE OWNERS OF THE ADJACENT REAL PROPERTY IN THE MANNER PROVIDED BY SECTION 50..1124 OF THE IDAHO CeDE; AND PROVIDII\'G FOR THE EFFECTIVE DATE OF THIS OIDINANCE. BE IT ORDAINED BY THE i'viAYOR AND CUJNCIL OF THE CITY OF MOSCOW, IDAHO: Section 1. That that portion of Public Read No. 437, entitled Re Extension of Moscow Sixth Street, lying and being located West of the west curb line of Rayburn Street North of Sixth Street as the same is now established, which Public Road is recorded in Book Three pages 608 and 609, Road Record, Latah County, Idaho, as follows, to wit: Beginning at a point one and forty•three hundredths (1.43) chains North of the common corner Sections Seven¯ (t7), Eighteen (18), Twelve (12) and Thirteen (13), Township Thirty-nine (39) North, Ranges Five and Six West, and running thence North seventy•eight degrees (78°) zero minutes (001) East six and sixty-five hundredths (6.65) chains, South eighty-seven degrees (87°) thirty minutes (30') East twent°six and thirty±five hundredths (26.35) chains, North eight°seven degrees (87°) zero minutes (OO') East eight and thirty-one hundredths (8.31) chains, which Public Road was declared to be a public highway and ordered opened and recorded by the Commissioners of Latah County, as shown by the record of the commissioners1 proceedings of the date of January 20, 1904, Book Four page 593, Commissioners Journal, Latah County, and which Public Road as herewith described is now located entirely within the corporate limits of the City of Moscow, be, and the same is, hereby vacated. Section 2. That the road so vacated shall revert to the owners of the adjacent real property, the Regents of the University of Idaho, as provided by Section 50..1124 of the Idaho Code. Section 3. This ordinance shall be in full force and effect from and after the date of its passage, approval and publication. Passed by the Council and approved by the Mayor this of March, 1962.
