Motion to approve the Consent to Assignment and Agreement to Assume Obligations between Martin Marietta Materials, Inc. and Morgan County 2. Motion to approve the year end financials and July 2013 payables to include General Fund in the amount of $481,572.21 represented by check #99484 thru check #99855 & SPLOST in the amount of $734,385.33 represented by check #1603 thru check #1623 . 3. Motion to accept the June 2013 Staff Reports as presented at the July 16, 2013 Work Session. ACTION - Approved Unanimously 11:00 A.M. Planning Commission Old Business: 1. Petition from Candace Carlson on behalf of William and Renee Pritchard for a variance to the rear setback for property located at 1000 Apalachee Way, Buckhead, Georgia (Tax Parcel 058A-030). (Tabled from July 2, 2013 Regular Board Meeting) ACTION - Withdrawn Mr. & Mrs. Pritchard withdrew their petition for a variance and are working with Planning & Zoning staff for a solution that will be administratively acceptable. 2. Petition from Michael Vaden for a conditional use permit to allow a zoo at 1021 River Farm Run, Madison, Georgia (Tax Parcel 049-010). (Tabled from July 2, 2013 Regular Board Meeting) ACTION - Approved the petition from Mr. Vaden for a conditional use permit to allow a zoo at 1021 River Farm Run, Madison with numerous conditions. Comms. Ainslie & Clack opposed the motion. Chair voted with the motion. Motion passed 3-2. ---PAGE BREAK--- New Business: 1. Petition from Josh A. Wheat, on behalf of Swords United Methodist Church, regarding a conditional use permit to allow a fellowship hall on property located at 1401 Swords Road, Buckhead, Georgia (Tax Parcel 058-021). ACTION - Approved unanimously the petition from Josh A. Wheat, on behalf of Swords United Methodist Church, regarding a conditional use permit to allow a fellowship hall on property located at 1401 Swords Road, Buckhead. 2. Petition from Ryan Taylor regarding the rezoning of 1.884 acres located at the intersection of the Highway 441 by-pass and Bethany Road, Madison, Georgia, from Residential Low Density (R1) to General Commercial (C2) (Tax Parcel 036-058A). ACTION - Approved unanimously the petition from Ryan Taylor regarding the rezoning of 1.884 acres located at the intersection of the Highway 441 by- pass and Bethany Road, Madison, Georgia from residential low density (R1) to general commercial (C2). 3. Petition from Ryan Taylor for a conditional use permit to operate a nursery on property located at the intersection of Highway 441 by-pass and Bethany Road, Madison, Georgia (Tax Parcel 036-058A). ADDED TO AGENDA - MAGISTRATE COURT SOLICITOR CONTRACT ACTION - Approved contract between Morgan County and Lee Moss for Magistrate Court Solicitor. *Time sensitive items submitted after work session.
