1-1 I P a g e Article 1 Purpose Table of Contents 1-1 Chapter 1.1 Objectives 1-2 Chapter 1.2 Legislative Authority 1-2 Chapter 1.3 Method of 1-2 Chapter 1.4 Construction of Provisions 1-2 Chapter 1.5 Incorporation by Reference of Maps 1-3 Chapter 1.6 Copies 1-4 ---PAGE BREAK--- 1-2 I P a g e Chapter 1.1 Objectives This Ordinance is for the purpose of setting forth standards and permissible uses designed to conserve and protect the natural, economic and scenic resources of Morgan County, the County’s health, aesthetics, morals, convenience, order, prosperity and general welfare; to provide adequate light and air; to protect natural resources; to prevent the overcrowding of land; to promote desirable living conditions and stability of neighborhoods; to facilitate the adequate provision of transportation, water, sewerage, schools, parks, and other public requirements by dividing the unincorporated areas of Morgan County into districts of such size and shapes as may be best suited to carry out the purposes of the legislative act and of this Ordinance. Chapter 1.2 Legislative Authority The Board of Commissioners of Morgan County, Georgia, under the authority of Article IX, Section 2, Paragraph 4 of the Constitution of the State of Georgia and Chapter 66, Title 36 of the Official Code of Georgia Annotated, and for the purpose of promoting the health, safety, morals, convenience, order, prosperity and the general welfare of the County, and designed to lessen congestion in the streets; to secure safety from fire, panic, and other dangers; to promote health and overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provision of transportation, water, sewerage, schools, parks, and other requirements, ordains and enacts into law the Official Zoning Ordinance for unincorporated Morgan County for planning, zoning and subdivision control purposes. Chapter 1.3 Method of Regulation The Board of Commissioners of Morgan County, Georgia, as authorized by the Constitution and the laws of the State of Georgia, adopts zoning regulations for the following purposes: to define certain words used therein; to create zone boundaries; to regulate the density in distribution of population; to provide for the gradual elimination of non-conforming uses of land, buildings and structures; to provide for the method of administration, amendment and enforcement; to provide for the imposition of penalties for violations; repeal conflicting ordinances and resolutions; and for other purposes. Chapter 1.4 Construction of Provisions This Ordinance and all inspections conducted and permits issued hereunder are hereby declared to be remedial, and shall be construed to secure the beneficial interest and purposes thereof, which are public safety, health and general welfare, through structural strength, stability, sanitation, and safety to life from fire and other hazards attributed to the built environment, including alteration, repair, removal, demolition, use and occupancy of buildings, structures or premises, and by regulating the installation and maintenance of all electrical, gas, mechanical and plumbing systems, which may be referred to as service systems. Quality control of the materials and workmanship is not within the preview of this Ordinance except as it relates to the purposes stated herein. The inspection or permitting of any building, system or plan, under the requirements of this Ordinance, shall not be construed in any court as a warranty of the physical condition of such building, system or plan or their adequacy. Neither the Morgan County Board of Commissioners nor any county official nor any county employee shall be liable for damages to any entity for any defect or hazardous or illegal condition or inadequacy in such building, system or plan, not for any failure of any component of such which may occur. ---PAGE BREAK--- 1-3 I P a g e Chapter 1.5 Incorporation by Reference of Maps The Official Morgan County Zoning Map(s) and maps included in the Morgan County Comprehensive Plan are by reference incorporated herein and made a part hereof.
