INSTRUCTIONS FOR OBTAINING AN ART GALLERY LIQUOR PERMIT LIMITED TO 15 SCHEDULED DAYS IN A YEAR These instructions are for informational purposes only and not to be construed as legal advice. Please call your attorney for any questions pertaining to obtaining a Liquor License as the Town cannot answer legal questions. Colorado is a dual licensing authority for the state's licensed retailers and Arty Gallery Liquor Permit holders. Liquor licensing in Colorado requires retailers to first obtain license approval at the local government level. Town Council of the Town of Monument, Colorado, is the “Local Licensing Authority” for all licenses issued within the Town of Monument, and is therefore charged with carrying out these State delegated duties. For new license applicants this typically requires showing the neighborhood needs and desires for each new liquor license. In addition, the Town will conduct an initial background investigation of the individuals involved with a retail liquor license application and will mail the applicants fingerprint cards to CBI. A background investigation typically includes: Applicant criminal history; Liquor license violation history; Ownership interests in other liquor industry members (Colorado has statutory ownership limitation) and Tax payment history. Art Gallery Permits permit complimentary alcohol beverage service by an Art Gallery whose primary business is to exhibit and offer for sale works of fine art. Alcohol beverage service is limited to fifteen days per year, and for no more than four hours per day. Approved days shall not be changed without a minimum of fifteen days' written notice to the state and local licensing authority. An art gallery shall not charge an entrance fee or a cover charge in connection with offering complimentary alcohol beverages for consumption only on the premises. An art gallery issued a permit shall not intentionally allow more than two hundred fifty people to be on the premises at one time when alcohol beverages are being served. Art Gallery Permits require a public hearing and posting notice. Please provide adequate time to process this application (minimum 45 days). The posting notice must be posted no later than 10 days prior to the event. The public hearing must be scheduled on a regular Board Meeting day which typically occurs the first and third Monday of every month. If the proper paperwork is not completed, received and processed by the Town Clerk to allow for the above timeframes, the event(s) cannot take place. Applicants must be present for the public hearing on all new Art Gallery Liquor Permits or the application will be denied. In order to process your permit, please submit the following to the Monument Town Clerk: NEW PERMIT: APPLICANT: Form 8443 (Art Gallery Permit) Diagram of premises with a bolded area of where the alcohol will be served Copy of lease showing occupancy and/or ownership Tax Certificate (Tax ID must match tax ID on lease or application will not be accepted) ---PAGE BREAK--- Fees for both CO Department of Revenue and Town of Monument CO Department of Revenue: Application fee License Fee $71.25 TOTAL FEE: $71.25 Town of Monument: Application fee $100; Permit fee $3.25 TOTAL FEE: $103.75 It is your responsibility to be in compliance with State Statute in regards to your permit.
