3 TOWN PARK USE GUIDE 1. Use of any park or portion thereof for a public gathering, entertainment, tournament or exhibition shall require prior permission by the Town Clerk. 2. Any person desiring to use a Town park or portion thereof per item No. 1 above shall submit an application to the Town Clerk at least fourteen (14) days prior to the date of the intended use. The application shall include the following information: A. Name & address of the person sponsoring the use. B. The dates and times for which permission is desired. C. The park or portion thereof to be used. D. How the park or portion thereof will be used. E. An estimate of the anticipated attendance or persons involved in the use or both. F. Any other information, which the town may require to make a fair determination as to whether or not permission should be granted. parking requirements, noise,etc.) 3. The Parks Department and/or the Town Clerk may grant permission if the following minimum conditions are found: A. That the proposed use of the park will not unreasonably interfere with or detract from the general public enjoyment of the park. B. That the proposed use will not unreasonably interfere or detract from the promotion of the public health, welfare and safety. C. That the proposed use is not reasonably anticipated to lead to or incite violence, crime, disorderly conduct or damage to park property. D. That the proposed use will not entail extraordinary expense to the Parks Department or the Town generally. E. That the park or portion thereof has not been previously reserved for other use at the same date and time requested in the application. 4. Insurance: As a condition precedent to the issuance of any permit, the Town Clerk may require public liability and property damage insurance naming the Town as co-insured with the permittee for or greater than the below listed amount: Each Occurrence/Property Damage $1,000,000 Some organizations/businesses may already have a certificate. Certificate or copies of the policy of such insurance shall be filed with the Town Clerk and shall be subject to the Town Attorney's approval as to the adequacy of protection. May be written for a short time only. As a condition precedent to the issuance of any permit to sell food or wares upon park property, the Parks Department shall require products liability insurance and inspection of such food products and facilities by the Health Officer of the County. 5. Indemnification: The applicant shall be responsible for any and all damages to property or injury to persons arising out of the exercise of the permit, officers, agents and employees form all suits, actions or claims of any character, name description brought for or on account of any injuries or damages received or sustained by any person or persons or property on account of the exercise of the permit or of any action or omission of the permittee thereunder, his agents or employees, or on account of the failure of the applicant to maintain or to provide necessary safety devices to ensure the safety of the public; and the applicant shall defend against any ---PAGE BREAK--- 4 such suit, action or claim and pay any judgment, with costs, which may be obtained against the Town, its officers, agents or employees growing out of such injury or damage. 6. Use of the Park: The applicant and all persons using the park in conjunction with the approved activity shall be bound by all park rules and regulations and all applicable ordinances and agreements to abide by the same shall be a condition precedent to the issuance of a permit. 7. Liability of a Permittee: The person/group to whom permission is granted shall be liable for any loss, damage or injury sustained by any person or property whatever by reason of the actions of the permittee. The permittee shall also be liable for the actions of any person using the park or portion thereof under the permit that has been issued. 8. Revocation: The Town Manager or delegated representative shall have the authority to revoke a temporary permit upon finding of a violation of any rule or regulation or ordinance, or upon good cause shown. Revocation may be immediate upon serious violation. 9. Park Uses for Commercial Purposes: "Commercial Purposes" for the purpose of this section shall be defined as the anticipated use of a park or portion thereof for an activity for which a fee or admission is charged, a class or course of instruction for which a fee is charged, a franchise or concession for the purpose of commercial movie making, or any other activity from which monetary benefit is to be derived directly or indirectly. Any person desiring to use a park or portion thereof for such commercial purpose shall apply to the Board of Trustees. 10. Art and Craft Shows: All arts and crafts exhibited at Art Fairs are to be handmade and sold by the individual that made the item and all exhibits at the fairs may be inspected by the Board of Trustees and/or Park Department. 11. Alcoholic Beverages: Alcohol is prohibited in Town owned parks without a Special Event Liquor Permit Permits can only be obtained by non-profit organizations and require board approval. A minimum of 45 days is required for an application for a Special Event Liquor Permit. Soliciting, Begging: It is unlawful for any person to solicit contributions, or to solicit patronage for any purpose upon any park premises. 13. Sales, Concessions: No person shall expose or offer for sale any article or thing, or no person shall station or place any stand, cart or vehicle for the transportation, sale or display of any such article or thing upon any park premises, except those persons granted permission by the Board of Trustees. 14. Advertising by Sign: No person shall erect or cause to be erected any sign whatsoever on any park premises or highway or road adjacent thereto without first having obtained a revocable permit from the Town. 15. Vehicles: All vehicles must park in designated parking only. Parking is for the general use of the public and cannot be reserved. 16. Fires: Fires are to be made only in fireplaces or grills specifically meant for such purpose. Please check with Town Clerk, or his/her assigns, to verify if fires are permitted during your rental period. The Town has the right to issue a fire ban at any given time to prevent wild fires during a high-fire season. 17. Deface: It is unlawful for any person(s) to injure, deface, destroy, sever or remove any park property. ---PAGE BREAK--- 5 18. Trash: Permittee must leave grounds clean of trash and debris. 19. Drugs: It is unlawful for any person to bring, use, sell, buy, or solicit illegal drugs in Town parks; including recreational marijuana. This is grounds for immediate arrest and termination of parks permit. 20. The driving of any stakes, posts, flags, or insertion of any device into the ground at any of the parks in Town is prohibited. This is to ensure there is no damage done to the sprinkler systems. To secure tents from blowing away, sand bags or weights may be used. By these guidelines, we wish to encourage appropriate use of our parks and public buildings and discourage improper usages, which will be detrimental to the image or reputation of our Town such as "flea markets”, which shall be prohibited.
