REQUEST FOR PROPOSALS REAL ESTATE BROKER SERVICES FOR TOWN-OWNED PROPERTY TOWN OF MONUMENT RFP NO: 25-005 RFP ISSUANCE DATE: , 2025 PROPOSAL DUE DATE: 2025 ---PAGE BREAK--- 1 REQUEST FOR PROPOSALS 1. Introduction The Town of Monument, Colorado (Town) is located along the I-25 just 20 miles north of Colorado’s second-largest City, Colorado Springs, and is an easy drive to Denver, just 53 miles to the north. The Town is a rapidly growing community, with excellent schools, beautiful surroundings, and easy access to outdoor recreation, all with that small-town feel that provides the quality of life that makes Monument so desirable. The Town is a home rule incorporated community, serving a population of 11,000 residents in north El Paso County. The Town operates under a council-manager form of government, consisting of a Mayor, Mayor Pro Tem, five Council Members, and a Town Manager. 2. Objective The Town is soliciting proposals from qualified real estate firms/brokers specializing in residential/commercial real estate sales for the sale of Town-owned property located at 980 & 992 Gold Canyon Road, Monument, Colorado (See Exhibit It is the intent of this RFP to have the successful firm/broker enter into a professional services agreement with the Town. Knowledge of the Town of Monument market is essential, as well as experience in the purchase/sale of properties in the region. 3. Property Available 980 & 992 Gold Canyon Properties– the Town owns these properties. The properties are part of the Village Center Planned Unit Development (PUD) and will be used for retail and services. The Town Council wants to sell these properties to a party committed to developing these properties in a manner compatible with the surrounding residential area and adhering to the underlying PUD Design Standards and additional standards that may be imposed by the current property owner, the Town of Monument. (See Exhibit A) 4. Scope of Services The successful firm shall agree to a mutually agreed upon contract with the Town of Monument to provide the following: 1. Develop strategies for the sale of designated Town-owned property (such as conducting a study of comparable properties). 2. Develop marketing materials (electronic and/or hard copy) to advertise sites for sale, distribute the materials to potential buyers via the appropriate form(s) of media, and report the results to the Town of Monument on an agreed-upon frequency. ---PAGE BREAK--- 2 3. Advise the Town of Monument on strategies to promote and sell the designated site. Public presentations may be required. 4. Participate in site tours for potential buyers of town-owned properties that are for sale.  5. Analyze offers from potential buyers and advise the Town of Monument with respect to negotiations. 6. Represent the Town in negotiations with a prospective buyer from the time of offer until closing. 7. Coordinate real estate transaction closings. 8. Coordinate all other customary activities and services associated with real estate transactions. 9. Provide as-needed advice on miscellaneous real estate matters. 5. Term of Agreement The agreement period for the successful broker/firm will be nine months from the date of the award. The agreement may be renewed for additional terms upon satisfactory performance by the broker/firm and at a negotiated rate agreed to in writing by both parties. Alternate agreement periods may be considered. 6. Tentative Procurement Schedule The following is the tentative procurement schedule for the RFP. The Town reserves the right to adjust this Schedule at any time. Date Action 9/17/2025 RFP Release Date 9/24/2025 before 5 p.m. Deadline to submit questions via email. 10/1/ 2025 Responses to questions will be posted on the Town’s website and BidNet. 10/10/2025 Proposals are due via email no later than 4:00 PM local time. 10/22/ 2025 Expected date by which a recommendation will be made to the Town Manager and the Town Council on the award of the proposal. 7. Proposal Submission A. Proposals must be submitted via email, clearly identified with the RFP title and ---PAGE BREAK--- 3 the words "Submittal" or "Proposal" in the email subject line, with all attachments, no later than the date and time indicated in the Schedule above, to: Maryam Moradian, Senior Planner, Town of Monument Email: [EMAIL REDACTED] B. All proposals must be submitted in PDF format. C. Submittals without the proper subject line identification may be considered routine emails and may not be considered. D. Proposals received after the deadline indicated above will not be considered and will be rejected for lateness. E. There is no expressed or implied obligation on the part of the Town to reimburse the responding firms for any expenses incurred in preparing proposals in response to this request. 8. Questions A. Questions regarding this RFP must be emailed to Maryam Moradian, Senior Planner, [EMAIL REDACTED], no later than the date and time indicated in the Schedule above. B. All questions must include the RFP title and the word “Question – RFP 25-005” in the email subject line. Questions without this subject identification may be considered routine emails and may not be considered. C. Questions communicated by telephone or in person will not be accepted. D. All questions will be responded to via BidNet Direct (formerly Rocky Mountain E- purchasing System) no later than the date indicated in the Schedule above. Any responses by the Town that change the terms, conditions, and/or specifications of this RFP will be posted on the website as an addendum. No other communications of any kind may be considered a change to the terms, conditions, and/or specifications of this RFP. 9. Submittal Requirements a. COVER LETTER: Provide a cover letter indicating your interest in serving as the Town’s real estate agent/firm to sell land in the Town of Monument and advise on other real property issues as needed. Please indicate the property/properties you are proposing to sell. You are not required to propose both properties. ---PAGE BREAK--- 4 b. BACKGROUND INFORMATION: List the years in business with a description of your firm, including size of firm, location, number and nature of the professional staff to be assigned to this contract, with a brief resume for each key person listed. c. EXPERIENCE SUMMARY: Describe your firm's pertinent real estate experience (minimum five years of previous experience with proven effectiveness). d. MARKETING METHODS: Describe the methods used to identify target user groups, as well as a description of the marketing materials and the strategy for presenting the site to a regional and national marketplace (when applicable). e. ADDITIONAL SERVICES: Describe additional relevant/unique services offered through your firm. f. FEE SCHEDULE: • State commission rate for listing and selling properties and for advising on miscellaneous real property matters. • The State proposed a method of compensation for representing the Town of Monument in negotiations for purchasing properties. • State any other costs the Town of Monument should anticipate relating to the real estate services to be provided. • State any required 'carry-over compensation' for your firm – meaning, compensation after the real estate service agreement expires. NOTE: Quoted fees shall be valid for a minimum of 90 days upon receipt. g. REFERENCES: Provide a list of three applicable references. Include name, title, and contact information for each reference, as well as a brief description of the specific services provided. h. CONFLICT OF INTEREST: To avoid a conflict of interest or the appearance of a conflict of interest, your firm should not engage in any outside activities that are inconsistent, incompatible, or appear to conflict with your ability to exercise independent/objective judgment in the best interest of the Town of Monument. Please outline all conflicts of interest that may exist for your firm in relation to providing real estate services for the Town of Monument. i. GOOD STANDING: Your firm must comply with Federal, State, County, and local units of government, which include maintaining good tax payment status and a good corporate registration status. Comments and exceptions to the proposed form of Services Agreement circulated in connection with this RFP, including, without limitation, the insurance requirements. ---PAGE BREAK--- 5 Post-award comments to the Services Agreement not included in the proposal shall not be considered. The proposal must be signed manually or electronically by an officer or person qualified to bind the vendor. 10. Withdrawal of Proposal Proposals shall be binding on the vendor and may not be withdrawn for a period of 60 days following the submission deadline. A vendor may withdraw its own proposal at any time before the submission deadline. 11. Evaluation of Proposals Proposals will be evaluated based on the following criteria: A. Ability of the contractor(s) to meet or exceed the requirements defined in the RFP; B. Experience, qualifications, references; C. Knowledge of the regional real estate market and ability to market to prospects beyond the region; D. Regional reputation and local presence/experience; E. Fee schedule; and F. Willingness to think “outside the box” and present innovative ideas for marketing the specific town-owned property designated for sale. The Town may impose a numerical valuation system to weigh criteria and rank proposals. 12. Procedure for Selecting a Proposal A. The proposals are expected to be evaluated by Town staff, who will make a recommendation to the Town Council. As part of its evaluation process, the Town may request clarifications and additional information, conduct customer reference checks, require a subset of finalist vendors to make a presentation to the Town's selection team, hold multiple rounds of review with a limited group of proposers, and take any other action necessary to perform a thorough and objective evaluation of each proposal. B. In the event the Town elects to accept a proposal, it shall accept in writing the proposal that, in its estimation, will best serve the interests of the Town. ---PAGE BREAK--- 6 C. After the proposal’s due date, the Town reserves the right to negotiate terms and conditions of the Agreement with a vendor(s), and (ii) modifications to a proposal with a single vendor without obligation to negotiate similar modifications with other vendors. D. The Town reserves the right to reject any or all proposals, waive any formalities, and negotiate contract terms with the successful vendor. The Town may disregard all nonconforming, non-responsive, or conditional proposals, act in the best interest of the Town, and terminate, modify, or suspend the RFP process. This RFP does not commit to the Town to award a contract. E. There is no expressed or implied obligation for the Town to reimburse the responding firms for any expenses incurred in preparing proposals in response to this request. F. All property rights, including publication rights of all reports produced by respondents in connection with services performed under the agreement, will be vested in the Town. In addition, respondents will not publish or release any of the results of their examination without the express written permission of the Town. G. The Town reserves the right to retain all proposals submitted and to use any ideas in a proposal, regardless of whether the proposal was selected. Submission of a proposal indicates acceptance by the Consultant of the conditions contained in the Request for Proposals, unless clearly and specifically noted in the proposal as submitted and confirmed in the contract between the Town and the Consultant selected. 13. General Terms and Conditions A. Interested Parties: All interested vendors are invited to submit a proposal in accordance with the terms, conditions, and specifications contained herein. B. Tax Exemption: The Town, as a home rule municipality, is exempt from sales and use taxes. Vendors should inform all prospective subcontractors and suppliers from whom they expect to obtain services or supplies of the Town's tax-exempt status. Following the award of the proposal, a tax exemption certificate will be furnished by the Town upon request by the successful vendor. C. Pre-Contractual Expenses: The Town assumes no liability for payment of any pre- contractual expenses incurred by prospective vendors, including but not limited to costs incurred in the preparation or submission of proposals. D. Non-Discrimination: The vendor, by submitting a proposal, agrees to not unlawfully discriminate against any employee of the vendor or the Town or applicant for employment or for services or any member of the public based on disability, race, sex, age, national origin, religion, sexual orientation, gender ---PAGE BREAK--- 7 identity or expression, marital or military status, pregnancy, political affiliation or any other status protected by federal or State law. E. Governing Law: The laws of the State of Colorado shall govern this RFP. The venue for any dispute arising out of or relating to this RFP shall be in the State of Colorado District Court for El Paso County. F. Public Record: All proposals submitted will become property of the Town and may be subject to public disclosure pursuant to the Colorado Open Records Act, § 24-72-201, et seq., C.R.S. Any language purporting to render the entire proposal or proprietary will be ineffective and will be disregarded. ---PAGE BREAK---
