3/26/2014 1 Liquid Waste Hauler Permit Conditions 1. Permittee shall discharge only contents contained in cesspools, septic tanks, or portable sanitary toilets into the receiving station designated for such waste at 1221 Sutter Avenue, Modesto, California. Waste from these sources, to be discharged at the City Wastewater Treatment Facilities, shall be sanitary sewage. No industrial, hazardous or toxic waste, including, but not limited to, grease, oils, sand, large solids, eggshells, volatile organics, solvents, paints and metal bearing waste will be accepted. 2. Permittee shall abide by all applicable provisions of the City of Modesto Municipal Code or, any applicable local, county, state, or federal code or regulation, and all conditions of this permit. Violation of any provision of said code, regulation, or permit, will be just cause for revoking or suspending this permit and/or imposition of reasonable fines pursuant to Modesto Municipal Code 5-6.711. 3. Permit is not transferable and must be renewed every 12 months or upon change of business ownership, or any change in size of tank used to haul waste. 4. If the permittee is found to be responsible for damage to the City of Modesto Wastewater Treatment processes, storm or sanitary collection system or for excessive deposits of objectionable materials in said systems, permittee will be required to bear the cost to the City for cleaning or restoring affected part of the system to proper working order. 5. Standard Insurance Requirements: Worker's Compensation - in compliance with the statutes of the State of California, plus employer's liability with a minimum limit of liability of $500,000. General Liability insurance with a minimum limit of liability per occurrence of $1,000,000 for bodily injury and $100,000 for property damage or $1,000,000 combined single limit. This insurance shall indicate on the certificate of insurance the following coverage’s and indicate the policy aggregate limit applying to: premises and operations; broad form contractual; independent consultants and subcontractors; products and completed operations. Automobile Liability insurance with a minimum limit of liability per occurrence of $1,000,000 for bodily injury and $100,000 for property damage or $1,000,000 combined single limit. This insurance shall cover any automobile for bodily injury and property damage. 6. A $100.00 security deposit must be filed with the City of Modesto Finance Department prior to discharging at the Septic Dump Station. 7. Violations referred to in the provisions of these permit conditions, unless otherwise stated, could subject the permittee to suspension or revocation of permit. Suspensions could be one week for the first violation, one month for the second violation, and one year for the third violation. In case of a determination of violation, the violator shall have fourteen (14) days to request a hearing. The Director shall provide a hearing within ten (10) days after receipt of request for hearing. At the hearing, the violator may present written or oral evidence why a violation does not exist or why the fine should be reduced or eliminated. The Director shall give written notice of his decision not more than ten (10) days after the hearing. In addition to the penalties provided herein, the City may recover reasonable attorney fees, court costs, court reporter fees and other expenses of litigation by appropriate suit at law against the person found to have violated this article. ---PAGE BREAK--- 3/26/2014 2 In addition to suspension or revocation of permit, violations may result in administrative fines of not more than $10,000 per day per violation, civil penalties of not more than $25,000 per day per violation, and/or criminal prosecution. 8. Permittee shall supply and use an extension or other hose attachments necessary to discharge waste directly into the designated receiving station for waste hauler's dumpage. Permittee shall not store hose at septage receiving station. Permittee shall ensure that the dump site is kept clean and any spillage must be washed down into the designated receiving station. Any cleanup necessary by the City will be billed to the permittee responsible for the cleanup. A minimum of $40.00 for City personnel labor costs will be applied. 9. Damage to the gate entry keypad by any permittee will be cause to charge the permittee for replacement costs. The replacement costs will include cost of the gate entry keypad, related hardware, and all related labor. Replacement of a lost or damaged gate card (proximity card) will be $15. 10. All waste haulers shall purchase dump tickets at the City of Modesto, Finance Department. Dump tickets will be presented at the facility office or other designated location prior to dumping. NO DUMPING WILL BE PERMITTED WITHOUT VALID DUMP TICKETS! 11. Permittee shall furnish reports to the City of Modesto Wastewater Treatment Facility using the provided format. The reports shall list the origin of each load of waste dumped at the designated receiving station. Reports shall list City Permit number, customer name, street address, city of origin, driver’s name, dump date, stamped ticket dump time, and indicate if the customer is a commercial business. The report must be legible (preferably typed). This report is due the 10th of each month for the previous month's dumping. 12. Permittee shall operate under a current City of Modesto Business License. 13. All discharges must take place between 6:30 a.m. and 4:30 p.m Weekdays only. The WQC Facility understands there may be special emergency situations that require use of the facilities. In the event of an emergency, the Senior Waste Water Treatment Plant Operator can be reached at (209) 652-2324. 14. Samples shall be provided upon request by each waste hauler from each load. a. The City will furnish sample bottles at time of presenting dump tickets. b. The hauler is to take a grab sample at the middle of the dumping cycle and deliver to the lab or other designated location. The outside of the bottle surface shall be rinsed clean and dried prior to delivery to the lab. 15. Permittee shall dump waste as permitted in these provisions, generated ONLY in Stanislaus County. No waste from outside the County shall be dumped at the Modesto Wastewater Treatment Facility. 16. All posted speed limits, inside the facility, shall be obeyed. 17. Only Vehicles listed in the Permitee’s Permit Application on file in the office of the Environmental Compliance Section or vehicles specifically authorized by the Environmental Compliance Section may dump any material to the City of Modesto Septic Dump Station. 18. Discharging of oil from the oil catch muffler is strictly prohibited. Any hauler found discharging oil condensate onto City property shall face enforcement actions, up to and including suspension and revocation of your Liquid Waste Hauler Discharge Permit.
