RESOLUTION NUMBER A RESOLUTION TO LEVY A SPECIAL ASSESSMENT AND TAX UPON ALL PROPERTY SITUATED WITHIN POOLED SIDEWALK, CURB, GUTTER AND ALLEY APPROACH BONDS SERIES 2010 OF THE CITY OF MISSOULA, MONTANA, IN THE TOTAL AMOUNT OF $885,000 EXCLUDING DEBT SERVICE, TO DEFRAY THE COST OF INSTALLING SIDEWALKS, CURBS, GUTTERS AND ALLEY APPROACHES PURSUANT TO RESOLUTION NUMBER 7539 AWARDING THE SALE OF BONDS. WHEREAS, the City Council of the City of Missoula, Montana ordered and directed the installation of sidewalks, curbs, gutters and alley approaches as listed in Exhibit A; and WHEREAS, the City Council of the City of Missoula, has issued Pooled Sidewalk, Curb, Gutter and Alley Approach Bonds Series 2010 in the amount of $885,000 pursuant to resolution number 7539; and WHEREAS, the cost of making said improvements to be assessed against the properties within the pooled bonds, excluding debt service costs, amounts to the sum of $885,000 which is to be paid by the properties listed in Exhibit A; over a period of years according to the term of the bonds; and WHEREAS, the properties listed in Exhibit A are to be assessed to defray part of the cost and expense of making said improvements; each lot, tract, piece, or parcel of land; and WHEREAS, the City Clerk has provided notice as prescribed in 7-12-4177 MCA and the City Council has conducted a public hearing on August 23, 2010, in accordance with 7-12-4178 MCA. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MISSOULA, MONTANA that to defray the cost and expense of making said improvements in Pooled Sidewalk, Curb, Gutter, and Alley Approach Bonds Series 2010, the City of Missoula hereby finally levies and assesses a tax upon all property listed in Exhibit A in the respective principal amounts, plus annually accruing interest. The amount of each partial payment of the special assessment, and the day when each such payment shall become delinquent is enumerated on the City Treasurer’s assessment rolls and is made a part herein by reference. BE IT FURTHER RESOLVED, that the assessments for Pooled Sidewalk, Curb, Gutter and Alley Approach Bonds Series 2010 which are listed in the City Treasurer’s assessment book are now due and payable to the City Treasurer of the City of Missoula, Montana and will become delinquent at 5 p.m. on November 30th and May 31st of each year in accordance with the official terms of the bonds until they are paid in full.
