South 39th Street Neighborhood Council Bylaws Adopted as amended, September 19, 2007 Page 1 of 3 South 39th Neighborhood Council By-Laws for Wapikiya, and Cold Springs Areas Original adopted date: June 3, 1998 MEMBERSHIP, ELECTIONS AND VACANCIES All residents of the area south of 39th Street, as defined by Community Forum, are members of the South 39th Street Neighborhood Council. Votes on neighborhood items may only be cast by South 39th Street Neighborhood Council residents. The leadership team shall have the right to verify eligibility to vote. Meetings held by the South 39th Street Neighborhood Council are open to the public. Businesses, churches, schools, neighborhood organizations and other entities within the neighborhood are eligible to designate a representative to attend meetings. Decisions shall be made by a majority of those present and voting. Decisions made by a majority vote may be accompanied by a minority report. The minority report will reflect the areas of opinion that differ from the majority. The minority report will be presented in writing to the meeting moderator within 10 days of the meeting. The South 39th Neighborhood Council leadership team shall be composed of two to five individuals. Leadership team candidates may nominate themselves from the floor or be nominated by others. The Leadership Team shall comprise those nominees receiving the highest number of votes. The Leadership Team should reflect the diversity of their neighborhoods in both age and gender as well as representing the main geographic areas [Wapikiya and Cold Springs]. The Leadership Team shall attempt to include at least one homeowner, one renter, one landlord and one school age youth residing in the South 39th Council area. Leadership Team members must also be members of the South 39th Street Neighborhood Council as defined in paragraph one of these bylaws. A Community Forum representative and alternate must be elected by the Neighborhood Council from among the leadership team members. The Community Forum representative is limited to 2 consecutive terms in this position. The neighborhood council will select a member of the leadership team as meeting moderator by a majority of those present and voting. The meeting moderator is limited to 2 consecutive terms in this position. The moderator will also serve as the leadership team chairperson. The moderator will be responsible for creating leadership team meetings. The Leadership Team may establish a permanent nomination committee whose function shall be to identify and recruit future leadership team candidates. Leadership Team terms shall be one year in duration. There are no term limits for leadership team members. If a vacancy occurs on the Neighborhood Council leadership team for any reason – nominations will be taken from the council for replacement candidates and the vacant position shall be filled by a majority vote of those present and voting at the next regular meeting. ---PAGE BREAK--- South 39th Street Neighborhood Council Bylaws Adopted as amended, September 19, 2007 Page 2 of 3 NOTIFICATION OF ELECTIONS Notification of pending elections shall be given at least 14 days prior to the scheduled elections. Notification shall be carried out either by direct mail, postings in the district, notification in the newspaper, or a combination of the above. Notification shall include the time and place for all elections. DUTIES OF OFFICERS The Leadership Team will designate a Secretary-Treasurer. The Leadership Team shall divide the following duties among themselves: Report to the Community Forum. Report to the City Council. Submit Minority Reports. Set up and maintain a communication system. Record meetings (minutes) and file with the Missoula City Clerk. Take attendance. The Leadership team will meet at least 4 times a year. They will set meeting agendas and file agendas with the Missoula City Clerk. Coordinate volunteers. Account for and report expenses and income in accordance with city fiscal policy Edit newsletter. Select members of the nominating committee. MEETINGS A regular meeting of the South 39th Neighborhood Council shall be held at least twice a year. Additional Neighborhood Council meetings may be called by a majority vote of the Leadership Team or by petition of at least 20 residents outside the Leadership Team. Notices and agendas of meetings shall be given in advance. Meetings shall be conducted in an open manner. If necessary a Three Minute Rule may be initiated to expedite Council proceedings. In the event of unruly or otherwise unproductive behavior during Neighborhood Council meetings Roberts Rules of Order shall be followed. Neighborhood Council meetings shall be open to the public and will be subject to the provisions of the Montana Open Meeting Law. Meeting agendas and minutes will be filed with the City Clerk in a timely manner. COMMITTEES Committees of the Neighborhood Council shall be formed by the Leadership Team as needed. These may take the form of standing committees of permanent duration or ad-hoc committees focused on a specific issue. Committees recommendations must be submitted to the Council for a vote before action can be taken. Membership on committees shall be open to all members of the Neighborhood Council. Committee members must have attended the previous committee meeting in order to vote on committee recommendations. Interested persons who live outside the Neighborhood Council area may attend and participate but may not vote. ---PAGE BREAK--- South 39th Street Neighborhood Council Bylaws Adopted as amended, September 19, 2007 Page 3 of 3 EXPENDITURES All expenditures shall be made with the approval of at least two members of the Leadership Team. All expenditures of city funds must be done in accordance with city fiscal requirements. AMENDMENTS Proposed amendments to these bylaws shall be presented for discussion at a regular meeting of the Neighborhood Council. Additional amendments may be presented by those present at the discussion meeting. All proposed amendments shall be available in written form within 10 days following the discussion meeting. Within 40 to 50 days of the first discussion meeting, the South 39th Street Neighborhood Council will hold a follow-up meeting to vote on the proposed amendments. No further amendments to the bylaws will be allowed at the voting meeting. A two-thirds majority of those present and voting is needed to adopt any amendment. BOUNDARY ADJUSTMENTS Members of the Neighborhood Council must approve any boundary adjustment by a two-thirds vote of those present and voting at a regularly scheduled council meeting before a recommendation may be submitted to the Community Forum. The Neighborhood Council must review its boundaries at least once every two years. COMPLIANCE The South 39th Street Neighborhood Council Bylaws comply with the current City Ordinance governing Neighborhood Councils. Amended: September 19, 2007
