RESOLUTION NUMBER A RESOLUTION LEVYING A SPECIAL ASSESSMENT AND TAX ON THE LOTS, PIECES AND PARCELS OF LAND SITUATED WITHIN STREET MAINTENANCE DISTRICT #1 OF THE CITY OF MISSOULA, MONTANA, FOR THE PURPOSE OF DEFRAYING THE COST OF FLUSHING AND REMOVING STREET RUBBISH FROM STREETS AND AVENUES IN THE DISTRICT DURING THE FISCAL YEAR 2010. WHEREAS, the Missoula City Council created Street Maintenance District #1 in the City of Missoula, Montana designating the streets and avenues to be flushed during the year ; and WHEREAS, in accordance with state law, the Missoula City Council, has directed staff to develop the following estimate of the total cost of flushing and removing street rubbish from the streets and avenues designated in Street Maintenance District #1 for fiscal year 2010: For once weekly flushing of the streets and avenues in downtown Street Maintenance District #1 for fiscal year 2010 $ 35,000.00 For pickup of street rubbish from containers in the right-of-way of downtown Street Maintenance District #1 for fiscal year 2010 $ 17,454.00 Subtotal $ 52,454.00 Subtotal: 2009 Street flushing estimate $35,000.00 2009 Street flushing actual 34,009.04 Difference 990.96 2009 Rubbish removal estimate $21,228.00 2009 Rubbish removal actual 7,551.00 Credit fr. Allied Waste appl'd during year 10,783.00 Difference $2,894.00 SUBTRACT Subtotal of difference between actual and estimate for FY 09 $3,884.96 Total estimated cost for FY 10 $48,569.04 WHEREAS, the City Clerk published a notice in the Missoulian on July 19 and July 26, 2009, announcing a public hearing would be held on this resolution levying assessments for Street Maintenance District #1 , in accordance with Section 7-12-4426; and WHEREAS, the Missoula City Council conducted a public hearing on August 3, 2009, and offered an opportunity for citizens to appear and comment on the proposed assessments for Street Maintenance District and . WHEREAS, each of the lots, pieces and parcels of land located in Street Maintenance District #1 shall be assessed according to each property's proportionate share of the district pursuant to the frontage foot option authorized by Section 7-12-4422, M.C.A. ---PAGE BREAK--- NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MISSOULA, MONTANA, that the lots, pieces and parcels of land located in Street Maintenance District #1 and listed in the City Treasurer’s assessment book described as follows are hereby levied and assessed their proportionate share of $48,569.04 based on the amount of street front footage to pay for the costs associated with street flushing and rubbish removal in fiscal year 2010: Bank Street from Higgins to Pattee; Front Street from Washington to West Broadway; Main Street from Washington to North Orange; Broadway from Washington to North Orange; Pine Street from Pattee Street to Woody; Spruce Street from Pattee Street to Woody; Alder Street from Pattee to North Orange; Railroad from Pattee Street to the North Orange Underpass; Pattee Street from Bess Reed Park to Railroad Street; North Higgins Avenue from the Clark Fork River Bridge to Railroad Street; Ryman Street from West Front to Railroad Street; Ryman Street from West Front to Railroad Street; Woody Street from Main Street to Railroad Street; and Washington Street from East Broadway to East Main; South Higgins Avenue to Brooks. BE IT FURTHER RESOLVED, that the assessments for Street Maintenance District #1 are now due and payable to the City Treasurer of the City of Missoula, Montana and will become delinquent on November 30, 2009, at 5:00 p.m. PASSED AND ADOPTED this 11th day of August, 2008.
