ADDENDUM No. ONE GREENOUGH DRIVE SIDEWALKS ARRA 8199(89), UNP 6997 CITY PROJ. NO. 09·030 CITY OF MISSOULA, MONTANA DATE: JANUARY 21,2010 ORIGINAL BID OPENING DATE: FEBRUARY 1, 2010 TO: ALL PLANHOLDERS The plans and specifications for the above referenced project are hereby modified and/or superseded by this Addendum NO.1. Bidders shall acknowledge receipt of this addendum in the space provided for below, and in Section 00300, BID FORM, in the Project Manual, and attach a signed copy of this Addendum NO.1 within the Project Manual. Addendum No.1 will be MAILED. The bid opening date has CHANGED to FEBRUARY 8,2010, 1:00 p.m. local time in the Mayor's Conference Room, Missoula City Hall, 435 Ryman, Missoula, Montana 59802. All other submittal requirements of the Bid shall be as described in the Contract Documents. INFORMATION Pre-Bid Meeting Minutes from January 20, 2010 are attached for bidders' reference. A second Addendum shall be forthcoming. SPECIFICATIONS The following specifications amend or supplement the Standard General Conditions of the Construction Contract, Section 00700. All provisions which are not so amended or supplemented remain in full force and effect. Differing site conditions. During the progress ofthe work, ifsubs-Uljace or latent physical conditions are encountered at the site differing materially from those indicated in the contract or if unknown physical conditions ofan unusual nature, differing materially from those ordinarily encountered and generally recognized as inherent in the work providedfor in the contract, are encountered at the site, the party discovering such conditions shall Addendum NO.1 - 1 M:\1657\021\Documents\Bidding\Addendum\1-Addendum 1.doc 1/22/2010 ---PAGE BREAK--- notify the other party in writing ofthe specific differing conditions before the site is disturbed and before the affected work is pelformed. (ii) Upon written notification, the engineer will investigate the conditions, and ifit is determined that the conditions materially differ and cause an increase or decrease in the cost or time requiredfor the performance ofany work under the contract, an adjustment, excluding anticipated profits, will be made and the contract modified in writing accordingly. The engineer will notify the contractor ofthe determination whether or not an adjustment ofthe contract is warranted. (iii) iVO contract adjustment which results in a benefit to the contractor will be allowed unless the contractor has provided the required written notice. Suspensions ofwork ordered by the engineer. Ifthe pelformance ofall or any portion ofthe work is suspended or delayed by the engineer in writingfor an unreasonable period oftime (not originally anticipated, customary, or inherent to the construction industry) and the contractor believes that additional compensation and/or contract time is due as a result ofsuch suspension or delay, the contractor shall submit to the engineer in writing a requestfor adjustment within 7calendar days ofreceipt ofthe notice to resume work. The request shall setforth the reasons and supportfor such adjustment. (ii) Upon receipt, the engineer will evaluate the contractor's request. Ifthe engineer agrees that the cost and/or time requiredfor the pelformance ofthe contract has increased as a result ofsuch suspension and the suspension was caused by conditions beyond the control ofand not the fault ofthe contractor, its suppliers, or subcontractors at any approved tier, and not caused by weather, the engineer will make an adjustment (excluding profit) and modify the contract in writing accordingly. The contractor will be notified ofthe engineer's determination whether or not an adjustment ofthe contract is warranted. (iii) No contract adjustment will be allowed unless the contractor has submitted the requestfor adjustment within the time prescribed. (iv) No contract adjustment will be allowed under this clause to the extent that performance would have been suspended or delayed by any other cause, or for which an adjustment is provided or excluded under any other term or condition ofthis contract. Significant changes in the character ofwork. The engineer reserves the right to make, in writing, at any time during the vvork, such changes in quantities and such alterations in the work as are necessary to satisfactorily complete the project. Such changes in quantities and alterations shall not invalidate the contract nor release the surety, and the contractor agrees to perform the work as altered. (ii) Ifthe alterations or changes in quantities significantly change the character ofthe work under the contract, whether such alterations or changes are in themselves significant changes to the character ofthe work or by affecting other work cause such other work to become significantly different in character, an adjustment, excluding anticipatedprofit, will be made to the contract. The basis for the adjustment shall be agreed upon prior to the performance ofthe work. (iii) Ifthe alterations or changes in quantities do not significantly change the character ofthe work to be performed under the contract, the altered work will be paidfor as provided elsewhere in the contract. (iv) The term "significant change II shall be construed to apply only to the following circumstances: When the character ofthe work as altered differs materially in kind or nature from that involved or included in the original proposed construction; or vVhen a major item ofwork, as defined elsewhere in the contract, is increased in excess of125 percent or decreased below 75 percent ofthe original contract quantity. Any allowance for an increase in quantity shall apply only to that portion in excess of 125 percent oforiginal contract item quantity, or in case ofa decrease below 75 percent, to the actual amount ofwork performed. Project Introduction and Description The project is located along the Greenough Drive corridor from the intersection of Spruce and Maple north to the intersection with the driveway to the waterworks trailhead. The project consists of new sidewalk and curb and gutter. The roadway will need to remain open to traffic during construction. The Rattlesnake project will be up and running by the time this project starts and the construction equipment wi!! be driving through this construction site to get to the Rattlesnake project. A. The FTP site is for information only. B. Contract Documents 1. ARRA Employment Reporting Requirement - Section 00200, Article 34 and Section 00840 (CTEP Special Provisions). The Contractor wi!! be required to submit the ARRA reports once a month. The reports shall contain cumulative payro!!, cumulative hours worked and cumulative amount of people working on the project. The Contractor will also be required to obtain this information from their Sub-Contractors and add it to their reports. City staff indicated that they wi/! need the reports by the 5th of each month in order to meet their reporting deadlines. 2. Buy American Requirement - Section 00200, Article 31 and Section 00811 (CTEP Special Provisions). The Bidder should read the Buy American Requirements. The certification for the Bid submittal is located at the end of the CTEP special provisions. 3. Wage Rates - Section 00900 (Davis-Bacon Federal rates). The wage rates that wifl be required for this project are located in Section 00900 of the Contract Documents (pink sheets). 4. City staff thought the award would occur sometime in early March. There will be approximately a month of review and turnaround time with the State prior to Award. 2. Contract Duration - Substantial = 60 calendar days, but prior to July 25, 2010 D. Final Completion/Payment = 90 calendar days E. Liquidated Damages - Section 00500 Article 4.03 Liquidated damages of $500 per day for Substantial and Final Completion sha{{ apply to this project. IV. Railroad requirements Section 00810, Attachment The railroad requirements for the project are located as an Attachment at the end of the Special Provisions. The requirements and insurance detailed in the Attachment shall apply to this project and Bidders will need to take that into consideration when preparing their bid. V. Addendum NO.1 - Planned for later this week VI. Questions and General Discussion General Comments During the Meeting: 1. If the base of the sign is not standard or damaged, City staff will set the new base. 3. The City is willing to consider different methods for constructing the storm sewer manhole proposed over the existing RCP arch pipe. The City will have to approve the method. 4. The Buy American certification sheet looks to be out of date. Check with State staff to confirm it is the proper form. 5. The R/Wpermit cost may need to be adjusted by Addendum. 6. The Bidder should plan to pay for the OEQ and City permits for storm water. 7. The City will need to consider the scope of the project when the final bids come in. There is finite funding available for the project.
