City of Missoula, Montana Item to be Referred to City Council Committee Committee: Public Works Committee Item: Right-of-way Encroachment for 1522 South Reserve Street Date: February 17, 2010 Prepared by: Doug Harby Initiated by: Bill Hoff, Property Owner Action Required: Request for right-of-way encroachment permit for a ground sign at 1522 South Reserve Street. Recommended Motion: The committee recommends the City Council approve a right-of-way encroachment permit for a ground sign at 1522 South Reserve Street. Timeline: Referral to committee: 2/22/10 Committee discussion: 2/24/10 Background and Alternatives Explored: Applicant wishes to replace his existing sign with a new ground sign. During a survey of the property it was discovered that a 21.48’ City road easement existed between his property and the MDT Reserve Street right-of-way. Evidently this easement was not known until this survey. It was originally a County road easement but, due to annexation, it is now a City road easement. The existing sign is located within this easement as are many others along Reserve Street. The applicant wishes to replace the existing sign with a new sign which will also be located within this road easement. A right-of-way encroachment permit must be approved before his building permit can be approved. The City of Missoula Engineering Division supports this encroachment.
