Todd Klietz - RE: Variance for stemwall construction Hi Todd, As you are aware the State of Montana modified the floodplain regulation this past legislative session to align our ARM’s with FEMA CFR’s in the area of elevating a structure. Previously the Montana ARM’s only allowed for the elevation of a structure through the use of fill. Montana ARM 36.15.204d now allows for the elevation of a structure on stem walls. Since this is a new option that the local communities have not had time to adopt, and it is an option that is available under FEMA and now State floodplain regulations, the DNRC thinks that it would be reasonable for Missoula Co. to grant an variance to Barbara Sharp to elevate her structure on stem walls. The structure should still meet the Missoula Co. and DNRC guidelines requiring that the lowest floor and all mechanicals be elevated 2 ft. above the published 100 yr. flood depth at her location. I would also recommend that you make sure that Mrs. Sharp and her contractor get a copy of the AMFM Stemwall publication for reference. Please contact me if you have any questions. Larry A. A letter or just a simple email that says something like: "As authorized by ARM 36.15.204d, DNRC recommends approval of a variance for Barbara Sharp to construct a replacement home outside of the floodway without the use of fill on stemwalls provided that the lowest floor is a minimum of 2' above the published flood depth." I would have said 2' above BFE but this is in an AO depth 1. Larry - I know you've seen this one before but if you want to run out and take a look, lemme know...
