Timeline: Revised Referral to committee: May 3, 2010 PAZ Committee Action: May 5, 2010 Action Item City Council Action: May 10, 2010 (Consent Agenda or Committee Reports) Deadline: NA Background: The Office of Planning and Grants received a request from Rick McCool and Eli & Associates to adjust the filed plat of Grove Street Addition, a minor subdivision at the corner of Grove Street and Gleason Street in Orchard Homes (Attachment The subdivision was approved by City Council at its regularly scheduled meeting on February 7, 2005. The subdivision plat was filed in 2009. The Plat, Annexation and Zoning (PAZ) Committee heard a request for a proposed change of access for Lot 2 in the northeast corner of the subdivision. The applicant requested access for this lot from the shared access drive that was originally approved to serve Lots 1, 3 and 4. Lot 2 would no longer have direct access to Grove Street. Lot 4 was requested to access directly from Gleason Street, and no longer have access via the shared access drive. Staff recommended new conditions addressing the requested changes for Lot 2 and Lot 4. A new condition of approval required the recording of documents that facilitated legal access for Lot 2 via the shared access drive. The condition also requires an amended shared maintenance agreement for the shared access drive that includes Lot 2 and excludes Lot 4. A second condition requires the abandonment of the Grove Street access for Lot 2 prior to building permit approval. Subsequent to committee discussion, the applicant submitted a request to delete the requirement for residential sprinklers in the new homes (Attachment In 2005 when the subdivision was reviewed, a Mountain Water main had not yet been installed in Grove Street. The water main has since been installed, and a fire hydrant has been added adjacent to Lot 4 in the subdivision, providing a water supply for firefighting. In addition to the new request regarding the sprinkler condition the applicant has also requested that the plat adjustment condition of approval requiring driveway abandonment prior to building permit approval be amended to require abandonment prior to Certificate of Occupancy. ---PAGE BREAK--- Agency Review: The City Fire Department supports the fire hydrant providing a water supply for firefighting, subject to an onsite inspection (Attachment The inspection has not taken place as of the April 29, 2010 request date of the applicant. City Engineering has not had an opportunity to comment on the request to amend the condition requiring Lot 2 to abandon its Grove Street access prior to building permit approval. Staff will obtain comments from these agencies and provide a recommendation prior to the May 5, 2010 PAZ committee meeting. The recommendation will address a revision to the timing of Lot 2’s Grove Street access abandonment as well as a recommendation regarding the request deleting the condition requiring residential fire sprinkler systems.
