August 25, 2010 Starr Sullivan Wastewater Superintendent City of Missoula 435 Ryman Street Missoula, Montana 59802-4297 RE: Missoula WWTP Headworks and Odor Control Improvements Project Bid Documents Review and Award Recommendation Dear Starr: We have reviewed the Bid Proposals and related documentation from the bidders for the Headworks and Odor Control Improvements project, which opened bids on August 3, 2010. This letter serves to document our review of the bid submittals, addresses a protest by a project bidder, and makes an award recommendation. Submitted Bids. The apparent low bidder is Dick Anderson Construction, Inc. out of their Bozeman, Montana office with a Base Bid amount of $7,768,475.00. Enclosed is the Bid Tabulation of the ten (10) bids received and includes the Engineer’s Estimate of probable costs. There were no irregularities in the submitted bids. Dick Anderson Construction’s (DAC) base bid was 8.4% below the second low bid of $8,480,000.00 from Sletten Construction Company of Great Falls, and 14.6% lower than the Engineer’s Estimate of $9,094,000.00. The next three bids ranged from $8,489,200.00 to $8,673,200.00, which showed a very good and competitive set of bids. DAC’s bid had several bid items that varied from the other bids, both higher and lower, but overall did not show any unbalanced pricing. All required bid items in DAC’s bid proposal were included, filled out, and signed. In post-bid opening discussions with DAC, they stated that they stand with their bid. After a preliminary review of DAC’s bid proposal, supplemental information was requested in accordance with the bidding specifications. DAC provided a more complete list of proposed subcontractors; additional information regarding experience; and more detailed information on their proposed project superintendent. This type of information request is standard practice for projects of this size and complexity. In response to our request, DAC provided the attached letter dated August 12, 2010 which addresses their related experience, provides more detailed information on their project team, and included a more complete list of their proposed subcontractors. Article 3 of the Instruction to Bidders (Section 00200) in the Contract Documents refers to the bidders qualifications and states that consideration will be given to the following in determining if the bidder has the proper experience in performing work of a similar nature to the proposed project: 1. The Bidder maintains a permanent place of business; 2. The Bidder has adequate plant and equipment to do the work properly and expeditiously; 3. The Bidder has a suitable financial status to meet obligations incident to the work; and ---PAGE BREAK--- Mr. Starr Sullivan August 25, 2010 Page 2 of 3 4. The Bidder has appropriate technical experience with at least three comparable projects within the last 10 years involving rehabilitation or modification of water and/or wastewater mechanical treatment plants with a capacity greater than 3 mgd. Our review confirmed that DAC meets without exception items 1, 2 and 3 of the bidder qualifications. It was noted in the review of DAC’s list of comparable experience that while the firm has completed ten water and wastewater projects in the last 10 years, the plant capacities where those projects were performed may not be greater than 3 mgd. However, the 3 mgd criterion was a descriptor of convenience as a way of approximating project size and complexity for purpose of giving potential bidders a target level of experience and to allow the City to exclude potentially irresponsible bidders from contract award. Our detailed review of DAC’s experience included their plants of similar capacity, but also focused more closely on their overall level of experience with projects involving similar complexity as the construction of the Headworks project. The Headworks and Odor Control Improvements project has multiple elements of complexity including sheeting and shoring of a 36-foot deep excavation in close proximity of existing structures, dewatering requirements, large concrete structures including the entire lower level of the Headworks Building and two grit basins, and placement of large mechanical equipment. This point was discussed in detail at the mandatory Pre-Bid Meeting. Based on our review of DAC’s project experience and that of their subcontractors, we believe that DAC has demonstrated successful completion of numerous projects of a similar size and with similar complexity compared to the Headworks and Odor Control Improvements project. In the course of our review, we also contacted references from DAC’s comparable projects from the past several years. All project representatives that we contacted stated that DAC was a competent contractor that performed well on their projects. Specifically, the Owner of two larger DAC projects in California that included the Project Manager and Site Superintendent proposed for the Missoula project, gave high praise to DAC and stated that the DAC personnel were productive and professional, and were the most competent team that he had ever worked with. It should be noted that Morrison-Maierle has been involved with many projects with DAC, including the recently completed $4,000,000 Wastewater Treatment Plant in Conrad, Montana, the Missoula Caras Lift Station in 2008, and the Missoula University Lift Station in 2007. All of these projects were completed on time and within one percent of the bid price. Finally, a debarment check showed no record for DAC. Protest by Sletten Construction of the bid submitted by DAC. On August 24, 2010, The City of Missoula received a letter of protest to the bid submitted by DAC from Sletten Construction, the second lowest bidder on the project. Sletten Construction emphasizes in their letter the importance of Bidders’ qualifications, highlighting qualifications language in the bidding documents. Sletten Construction presents information in their letter that asserts DAC is unqualified to perform the work and that the City of Missoula should reject DAC’s bid as non- responsive and award the project to Sletten Construction in the amount of $8,480,000, an increase of $711,525 over the low bid. As described in the section above, we believe that DAC and their subs have adequately documented their experience with projects of similar complexity. Based on our review of the Bid Proposal, supplemental information, direct experience with the firm on other projects, and due consideration of the experience concerns expressed in the letter of bid protest, we recommend that the Headworks and Odor Control Improvements project be awarded to Dick Anderson Construction. Based on their submitted base bid amount, we recommend that the project be awarded with Additive Alternate no. 1 for a new SCADA server room and hardware in an amount of $127,000.00 for a total contract amount of $7,895,475.00. ---PAGE BREAK--- Mr. Starr Sullivan August 25, 2010 Page 3 of 3 We encourage the City to review the information presented and make a determination on awarding the project to allow for work to begin prior to arrival winter weather.
