RESOLUTION NUMBER A RESOLUTION LEVYING A SPECIAL ASSESSMENT AND TAX ON THE LOTS, PIECES AND PARCELS OF LAND SITUATED WITHIN RUSSELL PARK WEST PARK MAINTENANCE DISTRICT #428 AND WILLOWWOOD PARK MAINTENANCE DISTRICT #523 OF THE CITY OF MISSOULA, MONTANA, FOR THE PURPOSE OF DEFRAYING THE COST OF PARK MAINTENANCE IN THESE DISTRICTS DURING THE FISCAL YEAR 2010 WHEREAS, in Resolution 3706, the Missoula City Council created Russell Park West Park Maintenance District #428 in the City of Missoula, Montana; and WHEREAS, in Resolution 6132, the Missoula City Council created Willowwood Park Maintenance District #523; and WHEREAS, in accordance with state law, the Missoula City Council has directed staff to develop the following estimate of the total cost of maintaining Russell Park West and Willowwood Park for fiscal year 2010. Russell Park West Estimate for maintenance and care of the parkland in Russell Park West Maintenance District for fiscal year 2010 $3,432.00 FY 2009 Russell Park estimate $3,351.00 FY 2009 Russell Park actual $3,299.00 Difference $52.00 SUBTRACT Difference between actual and estimate for FY 09 $52.00 Total estimated cost for FY 2010 $3,380.00 Willowwood Park Estimate for maintenance and care of the parkland in Willowwood Park Maintenance District for fiscal year 2010 $4,242.37 FY 2009 Willowwood Park estimate $4,454.00 FY 2009 Willowwood Park actual $4,078.05 Difference $375.95 SUBTRACT Difference between actual and estimate for FY 09 $375.95 Total estimated cost for FY 10 $3,866.42 WHEREAS, the City Clerk published a notice in the Missoulian on July 19 and 26, 2009, announcing a public hearing would be held on this resolution levying assessments for Russell Park Maintenance District # 428 and Willowwood Park Maintenance District #523 in accordance with Section 7-12-4426; and WHEREAS, the Missoula City Council conducted a public hearing on August 3, 2009, and offered an opportunity for citizens to appear and comment on the proposed assessments for Russell Park West and Willowwood Park Maintenance Districts; and ---PAGE BREAK--- WHEREAS, each of the lots, pieces and parcels of land located in Russell Park West Maintenance District #428 and Willowwood Park Maintenance District #523 shall be assessed an equal proportionate share of the cost in accordance with 7-12-4162 (MCA). NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MISSOULA, MONTANA, that the lots, pieces and parcels of land located in Russell Park Maintenance District #428 are levied and assessed an equal proportionate share of $3,380.00 to pay for the costs of park maintenance in the district; and BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF MISSOULA, MONTANA, that the lots, pieces and parcels of land located in Willowwood Park Maintenance District #523 and listed in the City Treasurer’s assessment book are levied and assessed an equal proportionate share of $3,866.42 to pay for the costs associated with park maintenance in the district. BE IT FURTHER RESOLVED, that the assessments for Russell Park Maintenance District #428 and Willowwood Park Maintenance District #523 and listed in the City Treasurer’s assessment book are now due and payable to the City Treasurer of the City of Missoula, Montana and will become delinquent on November 30, 2009, at 5:00 p.m. PASSED AND ADOPTED this 3rd day of August, 2009.
