Recommended Motion: THAT the proposed phasing plan as shown in Attachment D for River Road Meadows Subdivision be CONDITIONALLY APPROVED subject to amendments to the subdivision conditions of approval to specify phasing as shown in Attachment E and in accordance with Article 4-7(2)(A-C) of the Missoula City Subdivision Regulations. Timeline: City Council’s Referral to committee: June 7, 2010 PAZ Committee Action: June 9, 2010 Action Item City Council Action: June 14, 2010 (Consent Agenda or Committee Report) Deadline: None Background: The Office of Planning and Grants has received a request from Eli and Associates to submit the final plat for River Road Meadows Subdivision in two phases. (Attachment River Road Meadows Subdivision was approved by the Missoula City Council on June 11, 2007 subject to sixteen (16) conditions of approval (Attachment On June 22, 2009 the Missoula City Council approved an extension to the final plat submittal deadline to June 11, 2010 (Attachment At this time the applicant proposes a phasing plan to submit the final plat in two phases (Attachment Phase 1 has a final plat submittal deadline of June 11, 2012 and Phase 2 has a final plat submittal deadline of June 11, 2013. In the request letter, the applicant cites the current economic climate as the primary reason for requesting the phasing plan. The requested phasing plan was described in an agency comment memo provided to City Engineering, City-County Health, City Fire and the City-County Floodplain Administrator on May 24, 2010. No adverse comments were received regarding the proposal. City Engineering noted that the on-site road and shared driveway be installed to the northern boundary of Lot 1 and include a physical barrier at the end of the shared driveway until the remaining improvements are installed in Phase 2. This is required in the staff recommended amendments to the conditions of approval to specify phasing (Attachment Staff Recommendation: Staff recommends conditional approval of the proposed phasing plan as shown in Attachment D for River Road Meadows Subdivision, subject to amendments to the subdivision conditions of approval to specify phasing, as shown in Attachment E and in accordance with Article 4-7(2)(A-C) of the Missoula City Subdivision Regulations. ---PAGE BREAK--- Applicable Subdivision Regulations: Subdivision phasing, including amendment of proposed phasing plans, is discussed in Missoula City Subdivision Regulations Article 4-7(2)(A-C): PHASING: Nothing in this section prohibits the phasing of a project over a period which exceeds three years if the subdivider provides a detailed plan for the future phases of the subdivision and the proposed timing of the phasing. The governing body reserves the right to impose additional conditions which require compliance with regulations which exist at the time that each phase is brought before the governing body for review. The applicant subdivider may propose, as part of the preliminary plat approval process, to delineate on the preliminary plat two or more final plat filing phases and to establish the schedules for submission of the phases; and, When phasing is not indicated on the preliminary plat, the final plat shall be submitted for the entire area shown on the preliminary plat. If the applicant desires to establish phases following approval of the preliminary plat, a new preliminary plat delineating the phases and establishing the schedule must be submitted and approved according to these Regulations. Modifications to an approved phasing plan or schedule shall require the approval of the governing body. Final plats of subdivision approved for phased development shall be filed sequentially in accordance with the approval. Financial Implications: None foreseen Attachments: A.
