City of Missoula, Montana Item to be Referred to City Council Committee Committee: Plat, Annexation and Zoning (PAZ) Item: Proposed Title 20, Missoula City Zoning Ordinance Rewrite Date: May 15, 2009 Prepared by: Laval Means Initiated by: OPG Urban Initiatives Work Plan Action Required: Set a public hearing at City Council for June 22, 2009 Recommended Motion: I move the City Council set a public hearing for an ordinance repealing Title 19 in its entirety, also known as the existing Missoula City Zoning Ordinance, and adopting Title 20, Missoula City Zoning Ordinance as recommended by the Planning Board. I move the City Council set a public hearing for an ordinance repealing Title 2.84 Historic Preservation Commission in its entirety. Timeline: Referral to committee: May 15, 2009 Committee discussion: May 27, 2009 Council acts to set hearing: June 1, 2009 Public Hearing: June 22, 2009 Background: Under contract with the City, Duncan Associates has prepared a comprehensive review, analysis, and rewrite of the City Zoning Ordinance. This process began in the fall of 2007 and has included more than 80 public meetings to solicit opinions relative to changes in the City's current ordinance. Duncan Associates submitted a Consolidated Public Review Draft (proposed Title 20) that incorporates suggestions and recommendations made by the Mayor’s Citizen Advisory Group, City agencies and the public to the Planning Board (serving as the City Zoning Commission) for their review and recommendations. The repeal of Title 2.84 is proposed because the language of that chapter is duplicated in Title 19 and is being revised and incorporated into Title 20. Planning Board held a public hearing beginning on March 3, 2009 to recommend repeal of Title 19 and the adoption of the Consolidated Public Review Draft as Title 20. After 16 public hearings, the Planning Board will receive a revised draft incorporating Planning Board recommendations for revisions. On May 19 and 20, 2009 Planning Board will review the revised draft and is scheduled to make a final recommendation on the project. ---PAGE BREAK--- City Council is responsible for approving, revising, or denying the repeal of Title 19 in its entirety, also known as the existing Missoula City Zoning Ordinance, and adoption of Title 20, Missoula City Zoning Ordinance as recommended by the Planning Board.
