Newman, OPG Initiated by: Bob Jaffe PAZ Action Required: Set a public hearing to adopt an ordinance to extend for six months the interim zoning, pursuant to MCA 76-2-306, of Parcels 1, 2, 3, and 4 of Dinsmore’s Orchard Homes Addition No. 4, Tracts 7, 11, and 12 located in the SW ¼ of Section 19, Township 13 North, Range 19 West, P.M.M., commonly known as The Gables Subdivision. Recommended Motions: 1. THAT the City Council set a public hearing to adopt an ordinance to extend the interim zoning of Parcels 1, 2, 3, and 4 of Dinsmore’s Orchard Homes Addition No. 4, Tracts 7, 11, and 12 for six months until June 15, 2010. Timeline: City Council’s Referral to committee: November 16, 2009 Committee discussion: November 18, 2009 (Suspend the rules) City Council acts to set hearing: November 23, 2009 Public Hearing: December 7, 2009 Background and Alternatives Explored: The subject property was annexed into the City unzoned with the understanding that it would be developed in conformance with the approved preliminary plat of The Gables Subdivision, approved by Council on May 22, 2006. The preliminary plat of The Gables expires on May 26, 2009. Without the previously approved land use proposal for this property the Orchard Homes neighborhood is no longer afforded the protection of predictable development in this area. Given the importance of zoning for predictable and sound land use, OPG Staff recommends a six-month extension of the interim zoning adopted for the identified property on June 15, 2009 while final zoning is considered. This extension will facilitate an accurate assessment of permanent zoning in light of the recently adopted Title 20 Zoning Ordinance.
