CERTIFICATE OF DNRC APPROVING AMENDMENT The Department of Natural Resources and Conservation of the State of Montana (the “DNRC”) is the holder of the City of Missoula’s (the “City”) Special Improvement District No. 534 Bonds and its Special Improvement District No. 536 Bonds which were issued pursuant to City Council Resolution Nos. 6998 and 7061 (the “Resolutions”). Pursuant to Section 13.4 thereof, the Resolutions may be amended with the consent of the DNRC. The City has delivered to the DNRC, Litigation Opinions as defined in the Resolutions from Mr. Jim Nugent, the City Attorney, and Dorsey & Whitney LLP, receipt of which is hereby acknowledged.
