ORDINANCE NUMBER AN ORDINANCE OF THE MISSOULA CITY COUNCIL AMENDING MISSOULA MUNICIPAL CODE TITLE 2, ENTITLED “ADMINISTRATION AND PERSONNEL”, CHAPTER 2.32 ENTITLED “POLICE DEPARTMENT” BY ADOPTING AND ESTABLISHING NEW SECTION 2.32.060 ESTABLISHING PURSUANT TO STATE LAW THAT MISSOULA POLICE OFFICERS MAY EXERCISE POWERS OF ARREST WITHIN FIVE MILES OF THE MISSOULA CITY LIMITS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MISSOULA THAT TITLE 2, CHAPTER 2.32, SECTION 2.32.060 OF THE MISSOULA MUNICIPAL CODE IS ADOPTED AS AN EMERGENCY ORDINANCE IN ORDER TO PROVIDE POLICE WITH JURISDICTION TO ENFORCE CRIMINAL LAW VIOLATIONS OCCURRING OUTSIDE THE CITY LIMITS, WHICH HAVE HERETOFORE HAD DIRECT IMPACT ON MISSOULA CITIZENS' FEELINGS OF PERSONAL SAFETY AND QUALITY OF LIFE: Section 1. 2.32.060 Authority to arrest – extension of jurisdiction outside city limits Pursuant to MCA 7-32-4301 this section authorizes Missoula city police officers jurisdiction and authority to enforce the criminal laws of the state and make arrests within five miles of the city limits. Severability. If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The council hereby declares that it would have passed this ordinance and each section subsection, sentence, clause, phrase, and words thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or words have been declared invalid or unconstitutional, and if for any reason this ordinance should be declared invalid or unconstitutional, then the remaining ordinance provisions will be in full force and effect. EMERGENCY ORDINANCE: This ordinance is enacted as an emergency ordinance for the reason that there are several areas bordering city limits where Missoula police officers are powerless to enforce criminal law violations that are affecting citizens' feelings of personal safety and quality of life. To adequately and timely address these problem areas passage as an emergency ordinance is necessary.
