Recommended Motion: 1. THAT the request to extend the preliminary plat approval period for the Clark Fork Terrace No. 2 Subdivision to extend the final plat submittal deadline to November 26, 2010, be APPROVED. Timeline: City Council’s Referral to committee: November 23, 2009 PAZ Committee Action: December 2, 2009 Action Item City Council Action: December 7, 2009 (Consent Agenda or Committee Reports) Deadline: December 8, 2009 Background: The Office of Planning and Grants has received a request from WGM Group to extend the final plat submittal deadline for Clark Fork Terrace No. 2 Subdivision to November 26, 2010(Attachment Clark Fork Terrace No. 2 Subdivision is a 33 lot subdivision on 47.38 acres located east of Deer Creek Road and adjacent to the Clark Fork River. The subdivision preliminary plat was approved on November 26, 2007, subject to 36 conditions of approval (Attachment The approval required the final plat to be submitted by November 26, 2009. Per City Subdivision Regulations Article 4-7(1), the applicant is required to submit the final plat by the deadline in the approval letter or request an extension of the preliminary plat approval period. The regulations state that the governing body may grant an extension to the preliminary plat approval period, “but in no event shall approval extend beyond three years from the date of plat approval”. The applicant has submitted a request for a one-year extension of the deadline, in compliance with the three-year limit in accordance with City Subdivision Regulations Article 4-7(1). Staff Recommendation: 1. Staff recommends approval of the request to extend the preliminary plat approval period for the Clark Fork Terrace No. 2 Subdivision to extend the final plat submittal deadline to November 26, 2010.
