City of Missoula, Montana Item to be Referred to City Council Committee Committee: Public Works Committee Item: MMC Title 15 Grading and Drainage Section (Relocated from Title 19) Date: October 2, 2009 Prepared by: Doug Harby Initiated by: Doug Harby Action Required: Set a public hearing to consider an ordinance and an emergency ordinance of the Missoula City Council adopting Missoula Municipal Code Title 15, new chapter, entitled Grading and Drainage. Recommended Motion: The committee recommends the City Council set a public hearing for November 23, 2009 to consider an ordinance adopting Missoula Municipal Code Title 15, new chapter, entitled Grading and Drainage. Timeline: Referral to committee: Oct 5, 2009 Committee discussion: Oct 28, 2009 to set public hearing Council acts to set hearing: Nov 2, 2009 Public Hearing: Nov 23, 2009 Background and Alternatives Explored: Former Title 19.71 Grading and Drainage was deleted in its entirety from the proposed Title 20 Zoning Ordinance with the intention of relocating it to Title 15. The reason for this is that Public Works has been charged with the review, inspection, and enforcement of the standard since its adoption. Placing it in Title 15 would allow Public Works to have direct authority for enforcement and to more easily refine and modify the specifications as needed. Most requirements set forth in this section are based on engineering standards which require a working knowledge of engineering practices to review and inspect. Financial Implications: None. This review and enforcement has been a part of the City Engineering work plans for many years. Costs are covered in the Grading and Drainage permit. Attachments: Ordinance Summary
