RESOLUTION NUMBER 7509 A RESOLUTION OF THE CITY COUNCIL AMENDING THE SCOPE OF WORK IN HOME INVESTMENT PARTNERSHIPS PROGRAM CONTRACT NUMBER 06-02 WITH THE NORTH MISSOULA COMMUNITY DEVELOPMENT CORPORATION. WHEREAS, THE CITY OF MISSOULA, at its regularly scheduled City Council meeting of Monday, February 6, 2006, approved Resolution 7027 to award $224,247 from the City’s Home Investment Partnerships (HOME) Program to the North Missoula Community Development Corporation to purchase land and develop approximately 16 homes for low- and moderate income first-time homebuyers at 1500 Burns Street in Missoula; and WHEREAS, THE CITY OF MISSOULA, at its regularly scheduled City Council meeting of Monday, August 17, 2006, approved HOME Contract 06-02 with the North Missoula Community Development Corporation to purchase of land and construct 16 new housing units; WHEREAS, has completed all of the activities within Section 5, Scope of Work, of Contract 06-02, including construction of 16 units of housing, although to date only five of the units have been sold or are under contract with low- and moderate-income households; and WHEREAS, THE STATE OF MONTANA has also provided HOME funding to the Burns Street project and, directed by the U.S. Department of Housing and Urban Development (HUD), has closed out its portion of the HOME project by reducing to two the number of units to be considered “HOME-assisted units”; and WHEREAS, in order to be consistent with the State HOME program and HUD’s direction, the number of units identified as HOME-assisted and funded by the City needs to be at least three to account for the balance of actual number of units sold or under contract; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MISSOULA, MONTANA, that bullet 3 of Section 5, HOME Contract 06-02, be amended to read “Will provide said housing to at least three occupants whose incomes are at or below 80% of the local median income, as determined by the U.S. Department of Housing and Urban Development (HUD), at costs within HUD's guidelines for affordability.” PASSED AND ADOPTED this 15th day of March, 2010 ATTEST: APPROVED: Martha L.
