- 1 - INVITATION TO BID Notice is hereby given that sealed bids will be received by the City Clerk, 435 Ryman Street, Missoula, Montana, until 1:00 PM MST, on March 29, 2010, and will then be opened and publicly read in the Mayor’s Conference Room for the furnishing of all labor, equipment and materials for construction of the following: CONSTRUCTION OF APPROXIMATELY 6700 LINEAL FEET OF CURB ALONG BROOKS STREET FROM MOUNT AVENUE TO HIGGINS AVENUE. Bidders shall submit sealed bids as prescribed in the project manual addressed to the City Clerk, City of Missoula, enclosed in sealed envelopes plainly marked on the outside “Proposal for City of Missoula Project 2009-043 Brooks Street Higgins Ave to Mount Ave Curb and Sidewalk.” The envelopes shall also be plainly marked with the bidder’s name, address and Montana contractor’s registration number and the following words: Project Name: Brooks Street Higgins Ave to Mount Ave Curb and Sidewalk City Project Number: 2009-043 A complete set of the Contract Documents and Project Manual will be furnished the Contractors making application therefore from the Office of the City Engineer, 435 Ryman, Missoula, Montana, upon payment of $50.00 by company check, cashier’s check, or bank money order (cash cannot be accepted). Full amount of payment will be refunded upon return of the plans and specifications in good condition within ten (10) days after bid opening. Persons or firms desiring to qualify or bid on this construction on the basis of a joint venture shall declare their intention by executing a Declaration of Joint Venture and Power of Attorney. Joint venture affidavits must be included with the bid proposal. Contractors and any of the contractors’ subcontractors doing work on this project will be required to obtain registration with the Montana Department of Labor and Industry (DLI) except as listed in MCA 39-9-211. Forms for registration are available from the Department of Labor and Industry, P.O. Box 8011, 1805 Prospect, Helena, Montana 59604-8011. Information on registration can be obtained by calling 1-800-556- 6694. Contractors are required to have registered with the DLI prior to executing the contract. Successful contractors and vendors are required to comply with City of Missoula business licensing requirements. All laborers and mechanics employed by contractors or subcontractors in performance of the construction work shall be paid wages at rates as set out in the bid proposal. Any contract entered into pursuant to this advertisement is subject to all appropriate federal laws, including Title VI of the Civil Rights Act of 1964. The City of Missoula hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this invitation; disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation. The Disadvantaged Business Enterprises’ contract goals are In accordance with Section 49-3-207, MCA, Contractors agree that for this contract all hiring will be made on the basis of merit and qualifications and that there will be no discrimination on the basis of race, color, ---PAGE BREAK--- - 2 - religion, creed, political ideas, sex, age, marital status, physical or mental disability, or national origin by the persons performing the contract. Each bid proposal must be accompanied by a certified check, cashier’s check, bank money order, bank draft, or bid bond payable to City of Missoula, in an amount not less than ten percent (10%) of the total amount of the bid. Successful bidder(s) shall furnish an approved Performance Bond and a labor and materials Payment Bond, each in the amount of one hundred percent (100%) of the contract amount. Insurance as required shall be provided by the successful bidder(s) and a Certificate(s) of that insurance shall be provided prior to issuance of the Notice to Proceed. Any objections to published specifications must be filed in written form with the City Clerk prior to the time and date set for bid opening. No bid may be withdrawn after the scheduled time for the public opening of bids, which is specified on the first page in this Invitation to Bid. The City of Missoula reserves the right to reject any or all proposals received, to waive informalities, to postpone the award of the contract for a period not to exceed sixty (60) days, and to accept the bid, which is in the best interests of the City of Missoula.
