Ordinance AN ORDINANCE OF THE MISSOULA CITY COUNCIL AMENDING SECTION 2.36.010 AND REPEALING SECTION 2.36.040 OF MISSOULA MUNICIPAL CODE PERTAINING TO THE BUREAU OF FIRE PREVENTION TO REVISE REFERENCES TO THE FIRE CODE ENFORCED BY THE BUREAU TO PROVIDE CONSISTENCY WITH CHAPTER 15.08. BE IT ORDAINED THAT SECTION 2.36.010 IS HEREBY AMENDED AND SECTION 2.36.040 IS HEREBY REPEALED AS FOLLOWS: Section 1. 2.36.010 Established. The Uniform Fire Code and NFPA Life Safety Code adopted by Chapter 15.08 of this code shall be enforced by the bBureau of fFire pPrevention is hereby established in the city fire department of the city and which is established and which shall be operated under the supervision of the chief of the fire department for the purposes of enforcing the fire code adopted pursuant to Chapter 15.08. (Ord. 2662 1989; prior code §11-17). Section 2. 2.36.040 Repealed.Alternate materials and methods. The city adopts and incorporates by reference the Uniform Fire Code adopted by the Montana State Fire Marshal. (Ord. 2662 1989). Severability. If any selection, subsection, sentence, clause, phrase or word of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause, phrase and words thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or words have been declared invalid or unconstitutional, and if for any reason this ordinance should be declared invalid or unconstitutional, then the remaining ordinance provisions will be in full force and effect.
