Page 1 of 3 RESOLUTION NUMBER A RESOLUTION OF THE CITY COUNCIL TO EXPAND THE DESIGNATED AREA OF THE MISSOULA FARMERS MARKET TO THE EAST FOR STORAGE, WASTE DISPOSAL AND RESTROOM FACILITIES. WHEREAS, the Missoula City Council has authorized the formation of the Missoula Farmers Market through the passage and amendment of Ordinance Number 1485, supported it pursuant to passage of Resolution Number 4888 and clarified the designated area of its operation through passage of Resolution Number 5176; and WHEREAS, the Missoula Farmers Market has proved to be an outlet for local farmers and gardeners seasonally; and WHEREAS, the Missoula Farmers Market has requested to expand the designated area of its operation to the east as shown on Exhibit attached hereto and made a part hereof. Said area is a triangular area adjacent to the current Missoula Farmers Market designated area and located in East Railroad Street right-of-way and will contain a storage building, a garbage container and portable toilets; and WHEREAS, the Missoula Farmer Market has worked with Montana Rail Link representatives to come up with improvements that blend well with the existing improvements that Montana Rail Link has made to the north and around the train depot; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of Missoula, Montana, that the current Missoula Farmers Market designated area be expanded to the include the triangular area as shown on said Exhibit subject to the following conditions: 1. Improve the existing wood chip/bark landscaping as shown on Exhibit attached hereto and made a part hereof. 2. Provide at a minimum, one ADA compliant portable toilet with access provided by a curb cut as shown on said Exhibit and one regular portable toilet. 3. Provide a 6 foot fence, gates and screening fence around the perimeter as shown on said Exhibit and Exhibit attached hereto and made a part hereof. 4. Provide a gate and curb cut for the garbage container and improvements as specified by Allied Waste. 5. During the off-season of the Missoula Farmers Market the portable toilet(s) and garbage container will be removed. 6. The City of Missoula will not incur any costs for this project except as approved by the City Engineer. 7. The Missoula Farmers Market will be responsible for any incurred damages and shall maintain the site at all times solely at the expense of the Missoula Farmers Market. 8.
