Recommended Motion: THAT the proposed phasing plan amendment for The Orchard Subdivision be APPROVED in accordance with Article 4-7(2)(A-C) of the Missoula City Subdivision Regulations. Timeline: City Council’s Referral to committee: July 13, 2009 PAZ Committee Action: July 15, 2009 Action Item City Council Action: July 20, 2009 (Consent Agenda or Committee Report) Deadline: July 21, 2009 Background: The Office of Planning and Grants has received a request from Trudy Smith of PCI to amend the approved phasing plan for The Orchard Subdivision (Attachment The Orchard Subdivision was approved by the Missoula City Council September 11, 2006 subject to fifteen (15) conditions of approval (Attachment A Phasing Plan, Plat Adjustment and Condition Amendment were approved on March 24, 2008 (Attachment Phase 1 was filed September 18, 2008. Phase 2 is required to be submitted by September 11, 2009. At this time the applicant proposes a phasing plan amendment to set the Phase 2 final plat submittal deadline at December 11, 2011 (Attachment The subdivision layout, including lot and road configuration, number of lots, and lot sizes, will not be changed from the phasing plan approved in March 2008. In the request letter, the applicant cites the current slowdown in the housing market as the primary reason for requesting the phasing plan. Staff Recommendation: Staff recommends approval of the proposed phasing plan amendment for The Orchard Subdivision in accordance with Article 4-7(2)(A-C) of the Missoula City Subdivision Regulations. Applicable Subdivision Regulations: Subdivision phasing, including amendment of proposed phasing plans, is discussed in Missoula City Subdivision Regulations Article 4-7(2)(A-C): PHASING: Nothing in this section prohibits the phasing of a project over a period which exceeds three years if the subdivider provides a detailed plan for the future phases of the subdivision and the proposed timing of the phasing. The governing body reserves the right to impose additional conditions which require compliance with regulations which exist at the time that each phase is brought before the governing body for review. ---PAGE BREAK--- The applicant subdivider may propose, as part of the preliminary plat approval process, to delineate on the preliminary plat two or more final plat filing phases and to establish the schedules for submission of the phases; and, When phasing is not indicated on the preliminary plat, the final plat shall be submitted for the entire area shown on the preliminary plat. If the applicant desires to establish phases following approval of the preliminary plat, a new preliminary plat delineating the phases and establishing the schedule must be submitted and approved according to these Regulations. Modifications to an approved phasing plan or schedule shall require the approval of the governing body. Final plats of subdivision approved for phased development shall be filed sequentially in accordance with the approval. Financial Implications: None foreseen Attachments: A.
