RESOLUTION NUMBER 7505 A RESOLUTION OF THE MISSOULA CITY COUNCIL ADOPTING MONTANA CODE ANNOTATED (MCA) TITLE 18 - PUBLIC CONTRACTS, CHAPTER 4 - MONTANA PROCUREMENT ACT, PART 3 - PROCUREMENT PROCEDURES AND THE ACCOMPANYING ADMINISTRATIVE RULES OF MONTANA (ARM) WHEREAS, the Missoula City Council places a high priority on fair and equitable processes for procurement of supplies and services as provided by Montana Law, and WHEREAS, the Missoula City Council supports competitive processes which are not only fair, but also lead to fiscally efficient and effective methods for expenditure of taxpayer’s dollars, and WHEREAS, MCA 18-4-124 states “Local government adoption of procurement provisions – alternative project delivery contracts. A political subdivision or school district may adopt any or all parts of this chapter and the accompanying rules promulgated by the department.”, and WHEREAS adoption of MCA 18.4.301-314 (Part 3) and accompanying rules provides for traditional and alternative competitive procurement processes, and WHEREAS, MCA 18.4.301-314 (Part 3) and accompanying rules establish the legal and procedural process for a Competitive Sealed Proposals method for procurement of supplies and services for such items including the following which is not all inclusive list: playground equipment and installation, flooring supplies and installation, alarm and security systems and installation, kitchen and concession equipment and installation, hardware and software purchase and installation, and WHEREAS, by procuring certain supplies and services through use of specific criteria provides the City with more competitive pricing, more complete services, extended warranty and guarantee possibilities, enhanced risk management, and other benefits when procurement of equipment along with installation by labor in and of the same contract or agreement, and WHEREAS, the City may as an alternative use the process for procurement of supplies and services as provided and outlined in MCA 18.4.301-314 (Part 3) and accompanying rules, and WHEREAS, the City, in adoption of MCA Title 18, Chapter 4, Part 3 also wishes to adopt accompanying Administrative Rules Of Montana (ARM) as follows: 2.5.301, 304 & 305; 2.5.402, 404 & 407; 2.5.502, 503, 505, 506 & 507; 2.5.601, 602, 603, 604, 609; 18.3.101; 18.4.122 & 126, and WHEREAS, it is the intent of the City to use alternative procurement methods as outlined in MCA 18.4.304, Competitive Sealed Proposals and accompanying ARM allowing for the competitive sealed proposals method of procurement of supplies and services. WHEREAS, competitive sealed proposals shall not replace Design-Bid or Design-Build, RFP for Architectural or Engineering services, or traditional sealed Bid procurements which are preferred for certain types of procurements; NOW THEREFORE BE IT RESOLVED THAT, the Missoula City Council adopts Montana Code Annotated (MCA) Title 18 - Public Contracts Chapter 4 - Montana Procurement Act, Part 3 - Procurement Procedures and the accompanying Administrative Rules of Montana (ARM) as an alternative purchase procurement procedure Approved and adopted on this 22nd day of February, 2010. ---PAGE BREAK--- ATTEST APPROVED: Martha L.
