City of Missoula, Montana Item to be referred to City Council Committee Committee: Public Works Committee Item: Vacating a portion of the 20’ Utility Easement in Glenn Addition Date: October 15, 2010 Prepared by: Dan Jordan, GIS Manager Initiated by: Dan Jordan, GIS Manager Action Required: Approve a Resolution Closing and Vacating a portion of the 20’ Utility Easement in Glenn Addition. Recommended Motion: The committee recommends the City Council adopt a Resolution Closing and Vacating all that portion of the 20’ Utility Easement granted in Glenn Addition described as the east 10 feet of Lot 6, Glenn Addition, as amended per plat of M & A Addition, Portion C, and the west 10 feet of Lot 5, Glenn Addition. Timeline: Referral to committee: October 15, 2010 Committee discussion: October 20, 2010 Council acts on Resolution: October 25, 2010 Background and Alternatives Explored: The owner requesting the easement vacation owns Lots 1 and 6, Glenn Addition, as amended per plat of M & A Addition, Portion C, Lot 5, Glenn Addition and Deed Exhibit 715. The owner would like to develop the parcel and this utility easement encumbers the parcel from the center of the parcel to the north (see “site plan”). Utilities (Blackfoot Communication, Bresnan Communications LLC, City of Missoula Engineering (Sewer), Missoula Electric Cooperative Inc, Mountain Water Company, Northwestern Energy LLC, and Qwest Corporation) have provided easement releases and have verified that they have no utilities in the easement and agree to release any interest in that portion of the 20' utility easement as shown on Exhibit A of the resolution. Eli & Associates, Inc. representing the owner on 8/11/10 contacted land owners adjacent to the easement and asked if they would be interested in joining this effort and abandon the easement on their property. They were given until 8/27/10 to respond or we would assume they were not interested. The attorney representing Maynard Sticht of Lot 4 was the only response and his client was not interested in participating in the abandonment of easement on his lot. He did not oppose the abandonment as it related to our client’s property. Financial Implications: No significant costs. Attachments: Resolution Exhibit A Site Plan
