RESOLUTION NUMBER A RESOLUTION TO LEVY A FINAL SPECIAL ASSESSMENT AND TAX UPON ALL PROPERTY SITUATED WITHIN SPECIAL IMPROVEMENT DISTRICT NUMBER 546 (PATTEE CREEK DRIVE TRAFFIC CALMING PROJECT) OF THE CITY OF MISSOULA, MONTANA, IN THE TOTAL AMOUNT OF $15,500 EXCLUDING DEBT SERVICE, TO DEFRAY THE COST OF MAKING THE IMPROVEMENTS IN SAID SPECIAL IMPROVEMENT DISTRICT PURSUANT TO RESOLUTION NUMBER 7441 CREATING SAID DISTRICT. WHEREAS, the City Council of the City of Missoula, Montana did create the above Special Improvement District and thereby ordered and directed to be made within the said Special Improvement District improvements as specified in the Resolution above-named; and WHEREAS, the cost of making said improvements to be assessed against the properties within the district, excluding debt service costs, amounts to the sum of $15,500 all of which is to be paid by the property located within said Special Improvement District; over a period of 10 years according to the terms of the financing secured to fund the district; and WHEREAS, the properties situated within said Special Improvement District is to be assessed to defray the entire cost and expense of making said improvements; each lot, tract, piece, or parcel of land to be assessed for its proportionate share of the whole cost of the improvement based on the formula as set forth in the Resolution creating the district. WHEREAS, the City Clerk has provided notice as prescribed in 7-12-4177 MCA, and the City Council has conducted public hearings on August 23, 2010, in accordance with 7-12-4178 MCA. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MISSOULA, MONTANA: That to defray the cost and expense of making said improvements in said Special Improvement District Number 546, the City of Missoula hereby finally levies and assesses a tax upon all property situated within said Special Improvement District in the respective principal amounts listed on Exhibit A attached, plus annually accruing interest. BE IT FURTHER RESOLVED, that the assessments for Special Improvement District Number 546 which are listed in the City Treasurer’s assessment book are now due and payable to the City Treasurer of the City of Missoula, Montana and will become delinquent at 5 p.m. on November 30th and May 31st of each year in accordance with the official terms of the financing secured to fund the district until the note is paid in full.
