PROPOSED AMENDMENTS TO TITLE 15 MISSOULA MUNICIPAL CODE TITLED MCC 15.64 GRADING, DRAINAGE, EROSION CONTROL AND STORM WATER POLLUTION PREVENTION PLANS SUMMARY PURPOSE OF AMENDMENT: The purpose of this amendment to MMC Title 15 is to relocate the Grading and Drainage Ordinance from Title 19 to Title 15. In addition erosion control and storm water pollution prevention is added to meet the new regulations adopted by the State and Local Governments. PUBLIC REVIEW: I will have this posted on the City web page then contact the engineering and architectural firms that use these standards on a regular basis and ask them to comment. ADDITIONAL CITY ENGINEERING STANDARDS AND SPECIFICATIONS: Our existing standard drawings and specifications will be revised to provide more detailed information regrading the new standards set forth in this proposed ordinance. 15.64.040 Permits 1. 1,2 Existing language minor housekeeping changes 2. 3, New establishing a permit for to allow enforcement of State and Local ordinances 15.64.050 Permit Fees 1. Existing grading and drainage permit fees for applicable parcels no change 2. New Fee fee required for all developments one acre or greater 15.64.060 Permit exemptions 1. No change 15.64.070 ,080 Permits Investigation Fees and Refunds 1. No change 15.64.090 General Requirements for Single Family Residential and Duplex parcels. All new The intent of this section is to develop guidelines for single family and duplex residential (multifamily and commercial shall retain water on site) properties for storm water management including properties on gentle slopes or even flat land. Issues to be considered are: i) that it is not reasonable to require all SFR parcels to retain all storm water on-site but they have a responsibility not to add to the existing predevelopment runoff. ii) that design guidelines should be established that best protects structures while allowing storm water runoff to be facilitated through the parcel to the next parcel, storm drain facility or public right-of-way iii) These standards have been established based on years of experience by the City Engineering Staff attempting to resolve issues of one developer creating drainage issues for adjacent properties ---PAGE BREAK--- iv) The basic premises for these standards is to prevent an upstream development from directing runoff towards a structure and to direct the grading of the subject parcels to direct runoff away from any structures and facilitate the movement of runoff to the appropriate destination. 15.64.100 General requirements for Multifamily, Commercial, and Industrial Parcels Requires all of the above to retain all storm water on-site per previous ordinances NEW Specifies that the drainage must be designed by a Civil Engineer and gives some guidance to the requirements and authority of the City Engineer. Parcels with less than 4 parking spaces shall meet the requirements set forth in 15.64.090 above. 15.64.110 Submittal Requirements Moved over from Title 19 with a few minor changes 15.64.120 Plan Requirements and Design Standards Moved over from Title 19 with a few minor changes and the addition of requirements 15.64.120 Air Quality, Water Quality and requirements All New Defines the requirements to prevent carry-on of dirt/mud/etc from construction sites/developments. Sets the requirements for the submittal Establishes an enforcement procedure.
