Box 16027 Missoula, Mt 59808 February 11, 2008 RE: Hauser Addition Subdivision Plat Adjustments, Condition Amendments, and Phasing Plan Amendments - City Council Action Dear Kristin, At its regularly scheduled meeting of January 28, 2008, the Missoula City Council voted unanimously (12-0) to approve the Hauser Addition Subdivision plat adjustments, condition amendments and phasing plan amendments as shown in Exhibits #1 and The approval is subject to the conditions listed in the attached document entitled “Conditions of Subdivision Approval” (Exhibit The reasons for the decision to approve the plat adjustments, amendments to conditions of approval, and the phasing plan amendment may be found in the public record. As part of this action, the City Council took action on the following items: 1. THAT the Plat Adjustment, for Hauser Addition Subdivision to reconfigure the lot layout and reduce the number of lots to 5 as shown in Exhibit #2 and the condition amendments as shown in Exhibit #1 be approved. 2. THAT the Phasing Plan Amendments, for Hauser Addition Subdivision be approved as follows: A. Phase I, Lots 1 and 5, preliminary plat approval ends August 7, 2008. B. Phase II, Lot 2, 3, and 4 preliminary plat approval period ends August 7, 2013. If you wish to appeal this decision you must follow the procedure established by M.C.A. §76-3-625(2) which states as follows: A party . . . who is aggrieved by a decision of the governing body to approve, conditionally approve, or disapprove a proposed preliminary plat or final subdivision plat may, within 30 days after the decision, appeal to the district court in the county in which the property involved is located. The statute includes the applicant within the definition of an aggrieved party. The deadline to submit the plat for final plat approval for Phase I is August 7, 2008 and for Phase II is August 7, 2013. You must submit the final plats by these dates or request an extension to the effective period of plat approval.
