THAT the request to extend the preliminary plat approval period for the Howard Raser Business Park Subdivision, to extend the final plat submittal deadline to November 19, 2010, be APPROVED. Timeline: City Council’s Referral to committee: October 5, 2009 PAZ Committee Action: October 7, 2009 Action Item City Council Action: October 19, 2009 (Consent Agenda or Committee Reports) Deadline: October 19, 2009 Background: The Office of Planning and Grants has received a request from the R. C. Hobbs Company to extend the final plat submittal deadline for Howard Raser Business Park Subdivision to November 19, 2010 (Attachment Howard Raser Business Park Subdivision is a 6-lot industrial subdivision on 7.5 acres located east of the Howard Raser Drive/Old Grant Creek Road intersection. The subdivision preliminary plat was approved on November 19, 2007, subject to 16 conditions of approval (Attachment The approval required the final plat to be submitted by November 19, 2009. Per City Subdivision Regulations Article 4-7(1), the applicant is required to submit the final plat by the deadline in the approval letter or request an extension of the preliminary plat approval period. The regulations state that the governing body may grant an extension to the preliminary plat approval period, “but in no event shall approval extend beyond three years from the date of plat approval”. The applicant has submitted a request for a one-year extension of the deadline, in compliance with the three-year limit in accordance with City Subdivision Regulations Article 4-7(1). Staff Recommendation: 1. Staff recommends approval of the request to extend the preliminary plat approval period for the Howard Raser Business Park Subdivision, to extend the final plat submittal deadline to November 19, 2010.
