Return to: City Clerk City of Missoula 435 Ryman Street Missoula MT 59802-4297 RESOLUTION NUMBER A RESOLUTION OF THE MISSOULA CITY COUNCIL OF THE CITY OF MISSOULA, MONTANA, VACATING A PORTION OF A 20 FOOT UTILITY EASEMENT IN GLENN ADDITION LOCATED IN THE SOUTHEAST ONE-QUARTER (SE¼) OF SECTION 20, TOWNSHIP 13 NORTH, RANGE 19 WEST, PRINCIPAL MERIDIAN MONTANA AS RECORDED IN THE MISSOULA COUNTY CLERK AND RECORDER'S OFFICE, MISSOULA, MONTANA AT BOOK 6 PLATS PAGE 23 (12/12/1960). WHEREAS, the property owner of Lot 6, Glenn Addition, as amended per plat of M & A Addition, Portion C and Lot 5, Glenn Addition have petitioned the City of Missoula to vacate a portion of the public utility easement (Petition No. 9499, dated October 4, 2010) as described herein and shown on Exhibit A attached hereto: The east 10 feet of Lot 6, Glenn Addition, as amended per plat of M & A Addition, Portion C and the west 10 feet of Lot 5, Glenn Addition; as shown on Exhibit A attached hereto and made a part of. WHEREAS, all utilities have provided easement releases and have verified that they have no utilities in the easement and agree to release any interest in that portion of the 20' utility easement as shown on Exhibit A. WHEREAS, said City Council believes that the reasons for closing and vacating said easement set forth are good and valid and that said easement should be closed and vacated. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of Missoula, Montana, that said easement is hereby closed and vacated. PASSED AND ADOPTED this day of 2010. ATTEST: APPROVED: Martha L.
